He mentions that he had a persuasion that there was nothing in the world not even himself but that didn't mean he did not exist because the 'I" which is him was persuaded, as for the same thing for him being deceived. It is the 'I" that allows him to exist because he is deceived. For instance, 'So that it must, in fine, be maintained, all things being maturely and carefully considered, that this proposition (pronunciatum) I am, exist, is necessarily true each time it is expressed by me, or conceived in my mind," (Descartes, 1). Once he has formulated this theory he thought he was nourished, that he was able to move, perceived, and he thought, he combines these attributes to the soul all which he doubts. He understands the only thing he cannot doubt is that he thinks, he exists even without those actions because they are not reliable.

Descartes does not doubt that he is a thinking thing being because even without a body we have a consciousness and the only way to have a sensory experience is to have a mind. He develops an argument called cogito ergo sum which means 'I think, therefore I am" he is arguing here that our mind is primary and our bodies are secondary. He states, 'And although I may, ... I have a clear and distinct idea of myself, in as far as I am only a thinking and unextended thing, and as, on the other hand, I possess a distinct idea of myself, in as far as it is only an extended and unthinking thing, it is certain that I , [that is, my mind, by which I am what I am], is entirely and truly distinct from my body, and my exist without it," (Descartes, 6). Descartes is saying that a 'thinking and unextended thing" the mind does not take up space but we do think, and an 'extended and unthinking thing" the body takes up space but does not think. When he says, 'I have a body," the 'I" is the mind. Descartes wouldn't doubt my theory that 'I am consciousness" because I don't rely on my senses to know that I do exist. As well I cannot doubt my conscious, because it is a form of thought.

David M. Armstrong from a materialism point of view would disagree with my theory and argue that we are just bodies instead of mind. He believes that science and materialism is best way we'll have understanding of the mind. He discusses a materialist theory of the mind called behaviorism meaning that the mind isn't behind the behavior of the body but a part of the physical behavior. However, he feels as if it is deeper than just behavior itself. So he then attempts to give behaviorism a different view which became the notion of a disposition to behave which is the tendency of a person to behave a certain way under certain circumstances. He uses glass as an example, glass will have a disposition towards shattering if put under pressure because of its brittleness. That is similar to the disposition of the mind. If we are upset that is a disposition to behaving that way but it can be expressed.

For example, Armstrong states, 'Thoughts are not to be identified with behavior, we think; they lie behind behavior. A man's behavior constitutes the reason we have for attributing certain mental processes to him, but the behavior cannot be identified with the mental processes,"(Armstrong, 213). His suggestion is that mental states are not just dispotions to behavior but physical states of the brain. Armstrong lastly speaks on a topic he calls 'The Problem Of Consciousness" he is looking for an attribute of the mind that correlates to a 'purely materialist theory of man" he gives an example of how a person can be driving a car for a period of time not aware of what he/she was doing and still maintain to drive. Therefor without being conscious mental processing is still occuring.

Schools should Start Later

STUDENTS are tired and overworked. Teachers and other school personnel don't understand this. They expect everyone's full attention and 100% participation all day every day no questions asked. They treat students like they are robots and can multitask multiple huge projects and everyday life and to get everything done soon but the truth is that the average student cannot do that. They handle an exorbitant amount of pressure socially, from school, from their parents and family, and even from themselves. They are stressed trying to complete their schedules every day and to not fall behind but there are just not enough hours in the day to get it all done, and completed correctly, and get all school work turned in on time, on top of the stuff needed to be done for their health, for social development, and for their own personal development. The education system expects too much and is causing more harm to the development of adolescents then they are helping.

It goes without saying that school has always been an early morning thing. Students have to get up early to be to school anywhere from 7 to 8:30. Since the beginning of America's education system, all schools across the country have started with a single set time, at which, students were all expected to be there, awake and ready to learn, but why is that the expectation(Wahlstrom)? Why does school have to be an early morning thing? As the body matures and ages natural sleep patterns change. The bodies natural sleep schedule changes so someone who “went to bed at 8 pm in elementary school”(Sosnowski)probably won't go to bed until after 10 pm once they are around high school age.

Students are tired and groggy. They don't want to participate or pay attention that early in the morning, it goes against the biological makeup of their brains(Wahlstrom). It affects everything including their grades in school. Studies have shown that the brain isn't even completely functional until around 10 am. “In the teens, the secretion of the sleep hormone melatonin...continues until about 8 a.m.” (Wahlstrom), and for students to be healthy they should not wake before seven in the morning. So

Students aren't the best time managers in the first place and they will overschedule themselves to try to improve and meet the high standards they are pressured by to be able to have good grades, to get into a good college, and to have a healthy social life (Sosnowski). To be healthy though teens need to play sports, hang out with friends, to have some free time to spend interacting with other people and not focused on school. However,

for a lot of teens, social life means electronics, phone, computers, or video games, but electronics cause interruptions in teens’ sleeping schedules. Tiredness can cause problems with social development. It can cause “mood swings and depression” in students and cause them to make poor choices, to hang out with the wrong crowd, to get into substance abuse and into trouble(Sosnowski). It is also plausible for juveniles who do not sleep enough to be corpulent or overweight due to not participating in physical activities, and/or facing depression(Wheaton). Increased depression is found to rise significantly in students who sleep less than 9 hours a night, and depression symptoms, such as hopelessness, a feeling of despair, and sadness, increase by 33 percent in teens who get 4 hours or less of sleep a night(Wahlstrom). So to improve high school students’ overall quality of life students need more sleep.

The national sleep foundation recommends 8-10 hours of sleep for students, so in order to achieve that schools need to institute later start times (Wheaton). Encouraging “high schools to modify start times to enable students to get sufficient sleep and subsequently improve their health, safety, academic performance, and quality of life'(Wheaton). By starting school later students get more sleep by being able to wake up later, instead of trying to go against their natural biology by making them go to bed early. By just sleeping longer by 30-40 minutes attendance would be higher and grades would increase(Dunster). Schools would get a better result academically and would have a better job teaching students by dilating school start times and allowing teens to get more sleep so that they can be more awake and active at school so that they can also spend less time worrying about homework and being caught up.

If the school would have less homework, less testing, on top of later school start time, teens’ would actually be able to get help and time manage better. They should have to deal with hours upon hours of homework and studying because it causes stress and depression. It severely compromises their health and if the school actually gave a damn about their students well being they would notice and take action

all of their obligations cause stress and compete for their attention causing reasons for sleep deprivation, excessive tiredness, depression, poor judgment skills, and harmful action. So stop putting so much pressure on them. Allow them to have time to relax, and for the school that may not be able if to find a way to do it, if they really cared about the students that will one day become the adults helping to support the country they find ways to make it possible. They would find ways to be able to grow and mature the way they need to so that they can be strong and ready for the adult life and the world ahead of them.

“Do the Right Thing” by Spike Lee

Although the film, “Do the Right Thing” by Spike Lee takes place in the late 1980’s, the film reveals important themes, issues, and ideas associated with how African American culture was perceived by the other minority races in Brooklyn, New York. Ramsay articulates how racial rhetoric can be further distinguished by examining the musical scores and cinematography throughout the duration of the movie. In his directorial piece, Do the Right Thing, Lee utilizes unique filming methods, such as, striking camera angles, contrasting musical scores, and recurring symbolism to show his audience that there are several tough realities that come along with being of African American descent and coinciding among other minority races in a small New York neighborhood.

The racial pressure and stereotypes prevalent in this movie are clearly brought to light in the scene where Mookie confronts Pino about his negative disposition towards African American people, and the scene quickly transition into each character spewing verbal insults towards each other and their respective nationalities. By using salient, slow-focusing camera angles, the director provokes an uncomfortable conversation about how minorities are exposed to unreasonable antipathy precisely because of the color of their skin. Dr. Tani Sanchez expands upon this notion in her book, “Understanding Black American Aspects of Hip Hop Cinema” by claiming that the use of stereotypes in films have a large impact on how viewers perceive each nationality in their everyday lives. For instance, “Cinema has played a distinct role in an American culture that eagerly consumed Black creations but mocked and ridiculed the humanity of the people who produced it” (17). The quote from Dr. Sanchez speaks on how there is a prominent history- dating back to early cinema-of arbitrary discrimination amongst African Americans portrayed in cinema.

Moreover, there are aspects of racial pressure in the film that are highlighted by contrasting musical genres like rap, jazz, and blues in various scenes. Ramsay articulates how the use of classical music in the film serves to deliver emotions of stress and signal that conflict may be about to occur, “Thus, I see the score not so much signaling community. It functions, rather, to highlight conflict and tension in the narrative world of the film” (316). The motivation for Spike Lee to develop this type of un-easiness with the viewer along the movie is to reinforce the theme of needless hatred and discrimination towards African American people. Additionally, Lee allows the viewer to relate to the environment of residing in Brooklyn in the late 80’s.

In contrast, the repeated use of the song “Fight the Power” with Radio Raheem carrying a boom box and walking along the streets creates a perception that a fight may break out any second. It is unique that we can see a contrast of musical genres used in the film to create similar emotions of-racial pressure, hatred, and animosity. According to Ramsay, “As the film progresses, however, the audience experiences a level of familiarity with “Fight the Power” because of its persistent use” (316). It is important to note that by doing this, Lee can also build the tension with his audience up until the tipping point, where Radio Raheem is killed and Sal’s Pizza Shop is burned down, which highlights the repeated themes of violence and loathing in the film.

If we compare the rhetoric towards African American culture in Do the Right Thing to a modern film like, “Get Out” directed by Jordan Peele, it becomes clear that there has been a massive progression towards racial equality since the late 1980’s. Get Out captures a similar theme, in where there are intentional feelings of uncomfortable racial hatred created within the audience. Whereas, Spike Lee uses more subtle film elements to create tension with the viewer to foreshadow the climax. For instance, Lee comments on his motivation behind the creation of Do the Right Thing, “I knew I wanted the film to take place in one day, which would be the hottest day of the summer. And I wanted to reflect the racial climate of New York City at that time” (Edwards, RollingStone). The quote shows that even though Get Out was made nearly 20 years later, and carries a similar message, there are still racial issues prevalent in America today.

With Do the Right Thing, Spike Lee showed his viewers a window into what a typical hot summer day in Brooklyn was like in 1989, while also delivering an important statement on racial injustice and police brutality against the African American race. Additionally, contrasting musical genres was a method used by Lee to provide the audience with conflicting feelings of community and ethnic strain. Growing up everyone has friends of all social classes and behaviors. Many live wealthy lifestyles, and others not so fortunate. Many children loved going home after school and living the 'Leave it to Beaver" home life. Others had a home life that was sad and created angst. They literally had nothing to eat and no safe place to sleep or rest their heads.

Having hardworking and devoted parents is essential to create a better society. This makes a big difference for any individuals success and how they wish to live their overall life. Discipline should play a big role in the life of children as they grow older. No one should have to experience friends or family members being incarcerated at such a young age. It is a burden for their families and society. This could be a shock or trauma, when juveniles are incarcerated and tried as adults. This process could have an everlasting impact in their lives as well as their surroundings. For this, and after doing some more research juveniles should not be tried as adults.

When children have family hardships growing up, as teenagers, they don't have parental guidance and support to determine what is right or wrong. The average teenager has more chances of being with the wrong crowd and making the incorrect decisions such as; trying drugs, larceny, murder, and even rape. Juveniles are also influenced by the internet and all its resources. The worldwide web offers information that could be used for good or to commit an endless amount of crimes. The lack of discipline and influences of social media and TV has had a large impact on the decisions that juveniles make and, on the people, they hang out with; which in some instances, the wrong people.

Many of the TV show's that are being watched in actuality contain a large amount of violence, drug usage, and alcoholism. This, along with the incorrect form of education opens the door for teens to become juvenile delinquents. One of the most important things in a child's education is for their parents to be involved in their education. When parents are involved in their child's education starting a young age, children have a higher chance of becoming successful citizens not only in school but outside as well. There are expectations set by the parent as well as society.

When parents do not participate in their children's education, nor have an expectation from them, there is a lack of nurture and guidance to push children to success. With the lack of guidance, children can end up in the wrong place because many parents expect their children's teacher to raise their child. When in reality, teaching is a partnership between parents and teachers, in which they shape and mold children and teens to become successful citizens.

Juveniles are accounted for about 16 percent of all violent crimes' arrests and 32 percent of all property crime arrests in 1999, which was when juvenile crime was at its all-time high (PBS.org). With the lack of parenting and guidance some states argue that sentencing juveniles as adults, is a method that where in society, the crime rate for juveniles would decrease, but in Minneapolis Minnesota, about 63 percent of the all violent crimes are committed by juveniles (Johnson). In theory, this statement argues that with tougher penalties, juveniles will not commit certain amount of crimes.

We assume that by a certain age, juveniles or young adults should be mature enough to know what is right and wrong. Not only are juveniles affected physically but also, juveniles are being denied education and subjected to various dangers.

All juveniles have the right to an education in correctional facilities, but a 2005 survey found that 40% of the jails and prisons had no educational services at all. In addition, juveniles that are imprisoned with adults are subject to mentally harmful practices and have less mental health services available to them in the prison system. When juveniles are sentenced as adults, they receive an adult criminal record (Lahey), which could result in restriction from many employment and education opportunities.

When there is a lack of education or employment, this means there is a higher chance of recidivism. So, it makes sense that juveniles that go through the adult system are 34 percent more likely to be arrested again (Lahey). This creates a cycle of juvenile incarceration that is incredibly expensive.

Ethically as in an adult or parent, it is imaginable for a young adult to be forced into the adult prison system, in hopes to regain some sort of rehabilitation for the crime he has committed.

Perhaps, solutions to this situation should be handled in a different manner. Should the education system of the United States be more involved with the process of rehabilitation as well, as helping to determine better solutions to the problem of juvenile delinquency? School social workers detect the signs of troubled students and try to guide them down the correct pathway. But this does not work for every student. As a result, those students end up in the wrong places at the wrong time. Parents should also, be committed and held accountable for minors mental and physical wellbeing. Parents are held accountable for truancy, but why not behavior? Our government could do more for our troubled teens. Maybe fund more institutions for mentally troubled juveniles, as well, as the ones who do not have any guidance/ support from their parents or guardians. Having these programs could be a very effective way to help troubled teens and create and maintain a better society

These are only some of the reasons why, juvenile should not be tried as adults, although juveniles are mature enough to commit the same crimes as an adult. The truth is that an adult's brain is not fully developed until after their mid-twenties and even after that everyone is susceptible to making mistakes that could result in traumatic mistakes. Prosecutors look at different factors before charging the juvenile as an adult. If the juvenile is found guilty of the crime, there are different sentencing options. Also, there are controversies around if juveniles are competent to stand trial and understand the criminal proceeding against them while being mentally capable for incarceration in adult facilities.

Juvenile Courts v Adult Courts

Despite the amount of similarities between the juvenile and adult criminal proceeding, some differences persist. One of the most notable differences is the role the judge plays in the court. Bumson had a juvenile hearing scheduled, but her appearance was waived, and the juvenile case was dismissed since the district attorney filed a direct file and transferred to an adult court.

Blended Sentencing

Some states blended sentencing laws typically cover the same class of serious or violent crimes as the transfer laws, but juvenile blended sentencing differs from the juvenile waiver in the juvenile court has the jurisdiction to directly impose an adult sanction. For example, an adult prison, contrary to the application of adult sanction through juvenile waiver is possible only by the adult criminal court (Garland, Melton & Hass, 2012, p.136). Some states give an opportunity to the judges to impose both juvenile and adult correctional sanctions, but many people believe is that by doing so the juvenile is exposed to dangers in adult prisons at a very young age. Blended sentencing has been designed to create a middle ground between traditional juvenile and adult sanctions (Alarid, 2014, p.310). According to Garland, Melton, and Hass (2012), there are three types of blended sentencing today, and all of them are widely used. The juvenile-exclusive model, this model has only been used in the state of New Mexico, it gives the judge the opportunity to impose either a juvenile or adult sentence at the judge discretion.

The second most used is the juvenile-inclusive model. This model allows judges to impose both adult and juvenile sentences, for example, the judge can impose a five-year sentence in a juvenile detention center and suspend the adult sentence, but if the juvenile fails to comply with the juvenile sentence, then he/she will finish the rest of the sentence in the adult corrections. Currently, twelve states use this model. Lastly, the juvenile-contiguous model. This model allows the juvenile court the authority to give a youth a juvenile sentence followed immediately by an adult sentence. Under this model, the juvenile is retained under juvenile jurisdiction until the state declared age of majority (18 years old). Currently, three states use this model Colorado, Rhode Island, and Texas. Thus, blended sentencing varies from state to state in its application and depending on the state the minimum age at which this type of sentencing can be applied varies greatly. For example, in the state of Massachusetts, the juvenile must be at least fourteen years old to receive a blended sentence, and only for certain felonies, on the other hand in the state of Alaska the juvenile must be sixteen or older. The state of Colorado has no minimum age requirement to administer a blended sentence.

Juveniles Competent to Stand Trial

Questions have arisen if a defendant is competent to stand trial. Moreover, the question is being asked if a juvenile is competent for court proceedings. Trial competency is not insanity, nor an inquiry into criminal responsibility. It is rather, the standard for trial competency, which was set out in Dusky v U.S. in 1960 directs the court to inquire “whether the accused has sufficient present ability to consult with his lawyer with a reasonable degree of rational understanding and whether he has a rational as well as a factual understanding of the proceedings against him” (p. 402). As noted, competency to stand trial means that the defendant needs to have sufficient ability to comprehend the significance of the criminal proceedings against him/her, the potential outcomes, and the ability to participate in the trial process and decision making about any relevant trial issues. How is adjudicative competence conceptualized? Well, mental health professionals and the courts have identified several types of abilities that are significant for the two broad capacities to which Dusky refers too. McGarry and associates (Laboratory of Community Psychiatry, 1973), developed a list that was relevant to the Dusky standards, and it was organized and broken down into four categories by Grisso (2000, p.142).

How Are Juveniles Affected While Incarcerated?

Juveniles who are charged and tried as adults are often placed in adult facilities, and in many instances are not getting an appropriate education and are subject to various dangers, anything from mental and physical. Many juveniles housed in adult facilities do not have access to any education or vocational studies. Some of the reasons include long wait lists, not enough funds to create programs or to staff the currently available programs to expand. As you can imagine, determining how much victimization occurs in jails and prisons is hard to detect because sometimes inmates are afraid to report due to retaliation. According to Daigle & Muftic (2016), gendered difference discovered in physical victimization is that when females are physically victimized, they are more likely to be victimized by another inmate that are males; males are more likely to be victimized by a staff member. On the other hand, younger, white inmates are more likely to experience physical victimization perpetrated by other inmates than by staff (p. 227). In adult facilities, juveniles are at a higher risk of victimization more than “any other group of incarcerated persons,” according to the National Prison Rape Elimination Commission report (2009).

Also, juveniles in adult facilities are in the same environment as older and more experienced criminals, which means picking up bad habits from them. Juveniles will tend to pick up negative behaviors, and that can lead to getting in trouble while in prions/jail. Moreover, juveniles are not just affected physically, but also mentally. In some instances, juveniles are placed in solitary confinement for their safety, to protect them from older or dangerous inmates. They are typically in a small cell for about 23 hours a day; restrictions include but not limited to radio, television, limited reading material and contact with staff and peers. In recent U.S. Supreme Court cases such as Roper v. Simmons, Graham v. Florida, and Miller v. Alabama have focused their attention on the immaturity of the adolescent` brain. These cases, along with the evolving developmental neuroscience have suggested that teenagers are especially vulnerable to the astonishing psychological stresses associated with placement in solitary confinement. According to Andrew Clark (2017) in a study conducted of one hundred completed suicides in juvenile detention center facilitates found that fifty percent happened at the time when they were confined to their rooms with only seventeen percent of the deceased on suicide precaution status at the time of their death.

Conclusion

Despite the differences among the juveniles and adults the United States law will continue to recognize that if a crime has been committed the prosecutor has to charge and tired the offender with the crime regardless of the age. The prosecutor in charge of the case has to determine the type of offense committed, the age of the offender, and the past criminal history, if any, to decide if the case should stay in juvenile court, and if so, will the judge impose a blended sentence. Or the case will be waived to adult court and the juvenile be tried and convicted as an adult.

Should Juveniles be Tried as Adults?

The topic of juvenile offenders being tried and punished as adults is a very touchy subject. Some people support the idea and many are opposed to it. Suppose two young teens age 14 get into an altercation and one decides to stab the other in the heat of the moment. This teen has committed a crime and should get punished for his or her actions. The question is whether the youth should get tried and punished in Juvenile Court or Criminal Court as an adult?

When children commit crimes such as murder, does that automatically make them adults? This is the question in which supporters ask. Or do children maintain some bits and pieces of childhood and innocence, regardless of the severity of their actions? This is what those in opposition question. Does one or two years younger than eighteen make much of a difference? Is it fair for one person, just seventeen years of age or younger to be tried in juvenile court, receiving a lesser sentence than someone who is just a few years older who committed the same crime? I believe juveniles who commit heinous crimes just like adults, should be charged as adults. No one should be exempt from punishment. A crime is a crime and for that reason, juveniles who commit violent crimes should suffer the same consequences. This paper will discuss the history and purpose of the juvenile justice system and the pros and cons of trying juvenile offenders as adults.

'Throughout the late 18th century, 'infants" below the age of reason (traditionally seven years old) were presumed to be incapable of criminal intent and were, therefore, exempt from prosecution and punishment. Children as young as seven years old, however, could stand trial in criminal court for offenses committed and, if found guilty, could be sentenced to prison or even to death." (Juvenile Offenders and Victims: 1999 National Report, National Center for Juvenile Justice). The juvenile court started more than a hundred years ago, it was created based on the idea that juvenile offenders shouldn't go through the adult criminal courts. The first juvenile court was formed in 1899 in Illinois. The juvenile court was created to handle juvenile delinquents based on their adolescence rather than the actual crimes committed. The purpose was to focus on the child or adolescent as a person that was in need of support and not on the action that brought him or her before the court. In juvenile court, minors are not charged with crimes, they are more so charged with wrongdoings/ misconducts. In court children were not looked at being guilty, they were judged as someone who made a mistake and committed a dreadful crime. The juvenile system was not created to send the youth to prison. It sent them to a training school, a rehabilitation program or reformatory.

Juvenile court proceedings were very much relaxed and easygoing. It was not suspenseful like Criminal Court. In Juvenile Court, the decision was usually left to the juvenile court judge. The duty of the judge was to act in the best interest of the child. The normal procedures that were required and available to adults, such as the right to an attorney, the right to know the charges brought against one, and the right to trial by jury were considered unnecessary in juvenile court. Court proceedings for the youth were closed to the public and their records were to remain confidential. The reason being was to prevent an interference with the child's ability to be rehabilitated and reintegrated into society.

During the 1980s and 1990s, the public called for getting tough with juveniles and trying them as adults. Because of an increase to violent crimes committed by juveniles, many started to push for state legal reforms in juvenile justice system, which would punish juveniles tougher for serious crimes, rather than stick to the traditional rehabilitation approach. In Trying Juveniles as Adults in Criminal Court: An Analysis of State Transfer Provisions, Patricia Torbet and Linda Szymanski states that 'This change in emphasis from a focus on rehabilitating the individual to punishing the act is exemplified by the seventeen states that redefined the purpose clause of their juvenile courts to emphasize public safety, certainty of sanctions, and offender accountability." This change in the system was brought about by belief that many saw the juvenile justice system as being too soft on delinquents, who are thought to be potentially as much a threat to public safety as adult criminals.

'In many jurisdictions, teenagers commit as many as ten to fifteen serious crimes before anything is done to them. It is amazing how ancient, archaic, and broken down the juvenile justice system."(Jeffrey A. Butts, Adele V. Harrell, Pg.9). Because children are young they get away with murder. They get multiple chances to learn from their mistakes, but some commit numerous violent crimes because they know they will get a light sentencing. The youth is wiser than we think. To many teens, getting arrested is cool to them. Many youths are in and out of juvie constantly and they are not learning from their previous mistakes. It is because the juvenile system is too soft on teens why some choose to take advantage of it.

Issues arising from juvenile delinquency proceedings hardly ever come before the U.S. Supreme Court. Beginning in the late 1960's, however, the Court decided a series of landmark cases that dramatically changed the character and procedures of the juvenile justice system. (Juvenile Offenders and Victims: 1999 National Report, National Center for Juvenile Justice). The 1999 National Report, National Center for Juvenile Justice describes a series of cases that made juvenile court more like criminal court, but still maintained some differences. Breed v. Jones 421 U.S. 519, 95 S.Ct. 1779 (1975) concluded that a waiver of a juvenile to criminal court following adjudication in juvenile court constitutes double jeopardy. In 1970, Gary Jones whom was seventeen years old, was charged with armed robbery. He was adjudicated delinquent on the original charge and two other robberies. Jones's attorney filed a writ of habeas corpus, arguing that the waiver to criminal court violated the double jeopardy clause of the Fifth Amendment. Upon appeal, the U.S. Supreme Court ruled that an adjudication in juvenile court, in which a juvenile is found to have violated a criminal statute, is equivalent to a trial in criminal court.

In re Winship 397 U.S. 358, 90 S.Ct. 1068 (1970) the court decided that in delinquency matters, the state must prove its case beyond a reasonable doubt. Twelve year old Samuel Winship, was charged with stealing $112 from a woman's purse in a store. A store employee claimed to have seen Winship running from the scene just before the woman noticed the money was missing; others in the store stated that the employee was not in a position to see the money being taken. He was adjudicated delinquent and committed to a training school. At the time New York juvenile courts operated under the civil court standard of a 'preponderance of evidence." The U.S. Supreme Court ruled that the 'reasonable doubt" standard should be required in all delinquency adjudications.

In the case of McKeiver v. Pennsylvania 403 U.S. 528, 91 S.Ct. 1976 (1971) it was held that jury trials are not constitutionally required in juvenile court hearings. Joseph McKeiver, age sixteen, was charged with robbery, larceny, and receiving stolen goods. He and about twenty to thirty other youth allegedly chased three youth and took twenty-five cents from them. At the hearing, his attorney's request for a jury trial was denied by the court. He was adjudicated and placed on probation. The State Supreme Court affirmed the lower court, arguing that of all due process rights, trial by jury is most likely to 'destroy the traditional character of juvenile proceedings." The U.S. Supreme Court found that the due process clause of the Fourteenth amendment did not require jury trials in juvenile court. As a result, these cases were the start of a change in the juvenile system from when it was first introduced.

What are some pros of trying juveniles as adults? It is argued that trying juveniles as adults will decrease crimes committed by the youth. Children may start thinking more carefully about their crimes, knowing they could receive adult sentence. The result of a heinous crime remains the same, no matter who commits it, whether it is an adolescence or an adult. Perpetrators should be held accountable and responsible for their actions. When kids get punitive sentencing, it acts as a warning to kids who are considering committing crimes. Light sentences do not teach the youth the lesson they need to learn. Kids today are more sophisticated at a younger age; they understand the implications of violence and how to use violent weapons. It is absurd to argue that a modern child, who sees the effect of violence around him in the news every day, does not understand what killing really is. The fact that child killers know how to load and shoot a gun is an indicator that they understand exactly what they're doing. Charging the youth as adults can possibly help reduce gang related crimes. Gang members tend to use teenagers to commit their crimes because they know that they will receive a lighter sentence than if they were to do it themselves. It is unfair for gang members to take advantage of young children, but punishing teens as adults for the same crime adults commit will send a message to gang members that they can no longer use teens to do their dirty work.

Many experts believe that trying juveniles as adults will only make matters worse. They feel that the juvenile prison system can help kids turn their lives around. Instead of trying adolescents as adults, rehabilitation helps to give the youth a second chance. Why rehabilitation? Rehabilitation is better for society in the long run than releasing someone who's spent their entire young adult life in general prison population. It is said that teenagers who are released from juvenile prison is far less likely to commit a crime than someone who was released from an adult facility. Another point that some argue is that children do not have the intellectual or moral capacity to understand the consequences of their actions. Recent Longitudinal neuroimaging studies demonstrate that the adolescent brain continues to mature well into the 20s. The studies suggest that the brain's prefrontal lobe, which some scientists speculate plays a crucial role in inhibiting inappropriate behavior, may not reach full development until age 20. (Johnson, S. B., Blum, R. W., & Giedd, J. N. (2009). Adolescent Maturity and the Brain: The Promise and Pitfalls of Neuroscience Research in Adolescent Health Policy. The Journal of Adolescent Health??: Official Publication of the Society for Adolescent Medicine, 45(3), 216?“221.) In addition, children should not be able to get access to deadly weapons and adults who make guns easily accessible to them should be held accountable as well.

How can we prevent juveniles from committing serious crimes that will land them in jail? Two ways I feel juvenile crimes can be prevented and keep teens from becoming incarcerated are to make access to handguns less accessible to the youth and to improve education for youth in poor communities. I believe these two options will be a start to keep the youth out trouble and to prevent them from being charged as adults when they commit serious crimes.

“Super Size Me” by Morgan Spurlock

Super Size Me is an extreme example of transformative consumer research looking at consumption issues in our country as well as the lack of ethics in the food industry. For 30 days Morgan Spurlock ate nothing but McDonalds; 3 times a day, trying everything on the menu at least once. He walked about 5,000 steps a day, the average steps an American male takes, but did no other exercise other than that. The final rule was he must Super Size any meal if offered. Spurlock was interested in further exploring the root causes of the obesity epidemic in the United States. Spurlock was able to track his on physical demise during this time period in order to demonstrate how the fast food industry is actively promoting poor nutrition in order to turn a profit. For Spurlock, the physical effects were brutal but the film really sheds light on the fact that no one has it worse than the low-income families who turn to fast food restaurants as a cheap and convenient way to feed their family every day.

Watching Super Size Me is not for the faint of heart. From the beginning the physical effects on Spurlock are clear. Just 5 days into the experiment Spurlock throws up on film after eating his first super sized meal and has already gained 5% BMI. This statistic in particular nearly blew my mind. This is obviously an extreme case but if we think about the number of families in America that are averaging in 5 fast food meals a week it only takes 3 weeks of eating fast food before their body experiences similar affects as Spurlock. Very early on in the film the causes behind the American obesity epidemic are already becoming clear.

By two weeks into the experiment Spurlock begins experiencing mental effects from his diet. He is actually depressed when he is not eating McDonalds, almost going through withdrawals from the high levels of sodium and sugar. Spurlocks' girlfriend makes a point to say the effects of the experiment are clear as he has lost most of his energy and sex drive. It is not a secret that a poor diet leads to a decrease in mental moral and can even lead to depression. Despite this being generally known, fast food is still the most readily and affordable food option in our country. Other than the mental effects, in week 2 Spurlock feels sick and starts to develop chest pressure.

By the time week 3 rolls around the physical effects of eating 3 fast food meals a day become nearly life threatening. Spurlock has trouble breathing, heart palpitations, has gained 17 pounds and is even warned he is on the path towards liver failure. This part of the documentary left me all but speechless. As mentioned earlier obviously no American family is eating 3 fast food meals a day. That being said the average American will eat fast foot 159 times a year or about 3 times a week. The fact that a restaurant can sell a product that is giving a man heart palpitations is mind numbing. It leaves me at a loss of words and highlights one of the many flaws in the American system.

In the final week Spurlock does his final physicals and we get to see the full circle results the experiment has had on him. To summarize the effects of eating McDonalds 3 times a day for 4 weeks Spurlock gain 24 pounds, 13% Body mass increase, and a 230 mg/dL increase to his cholesterol. The film ends with a powerful question; who do you want to see go first, you or them?

Super Size Me highlights the flaws in the American system particularly when it comes to food consumption. I think it is generally accepted eating McDonalds 3 times a day is not good for you but Spurlock was able to demonstrate in this film that eating a life time of McDonalds very well way kill you. The physical effects experiences by Spurlock during this time period coupled with consumption statics like how many Americans are actually eating fast food should strike fear in the heart of our government and policy makers. Unfortunately, the government has sat quietly and let this fast food corporations sacrifice public well-being for profit. I think the unfortunate reality that due to varying level of incomes this does not affect many Americans such as the rich policy makers who ate very little fast food as is. This leaves me wondering who is looking out for the little guy, the family of 6 in low income housing with limited food options. The unfortunate reality of the situation to date is that no one is.

This film really made me think about my time studying abroad in Glasgow, Scotland. I remember complaining to my parents in the beginning about the price of groceries and the small sizes. Looking back at it now these complaints are almost comical. I was complaining because the Scottish government actually cares about the well-being of their people. There were tremendously different standards in terms of what could be sold and an extreme reduction in the number or pesticides. Fruits and vegetables were similarly priced as things like chips and cookies rather than radically more expensive like they are in America.

Super Size Me summarizes the magnitude of the consumption problem in our country and the lack of ethics in the food industry.

Remember the Titans Film Review

I have just recently seen the movie ‘Remember the Titans’ and I absolutely love it. I personally love football movies but this one just blows them all out of the water. It was an amazing true story in Virginia. In 1971 the local school board was forced to integrate an all black school with an all white school and the football team was put to the test. They proved so many people wrong and made lifelong friends with the least expected. This is the true story of an African-American coach.

In 1971 the Williams High School hires a black head coach named Herman Boone to become the school's coach of the football team. The old coach Bill Yoast becomes the team’s defensive coordinator (whatever that is). During their practices, black and white football team members fight because of racial conflicts but in the end they get over it or are forced to get over it. Coach Boone is able to get racial harmony on the team but many people in the community don’t want a black coach at their high school. The Titan's go through a winning season and the team gains support from the community. The Williams High football players and their coaches confront the internal pressures of integration and the external pressures of political unrest due to the Vietnam War. To become champions despite all the harsh feedback of T. C. Williams High, they still push their hardest and make it work.

I loved the movie so much. I don’t really think there were any parts I didn’t like that's how good it is. My favorite scene from the movie is when they were in the locker rooms singing. It was so funny and then they started shooting “Yo Mamma” jokes. Another one is when they win the last game. It was so fun to watch. I really enjoyed the whole movie but those were the most enjoyable parts.
The lesson that I learned from this movie is that Fighting does not solve anything. I know that when making hard decisions fighting seems like a solution (trust me I have an older sister) but fighting does not fix anything. It doesn't even make you feel better because you usually end up with consequences afterward. Everyone has their reasons but fighting with people does not build a stronger relationship especially with the people who help you win your football games.
The people who would like this movie are people who like movies about racial tension, good endings, good friendships, and funny movies. I really recommend this movie because it was hilarious and had the best ending ever. I loved it so much and I wanted to watch it over and over and over again. I always thought that the movie would be boring and make no sense but when I watched it I knew that it was absolutely the best movie ever.

Importance of Analyzing Reality Television

Why is it important for us to analyze reality television? From the very beginning of television there has been a dramatic change on the content that is being aired. In the beginning of television most programming considered “explicit” was aired laterat night and shows that did not contain such content were aired at primetime where the family could comfortably watch tv without worrying as much. From my experience I believe that there are talk shows, cartoons, and channels that are supposed to be family oriented that are not suitable for younger audiences to watch, much less children. There is no censor with what is now a big craze that is reality tv, people have no filters on what they do or say on tv to get some airtime. Such reality tv has given people an un realistic, false reality of what real life situations and expectations are, people of all ages are affected by what they see on television, children are at a very vulnerable age that everything they see and hear has a developmental impact on how they will form into adult hood. People on these reality tv shows don’t realize the impact they have on the young followers who watch their shows, they are flooding the airway with sexuality, violence, and unattainable life styles. I believe we are in a state of decadence when it comes to this new generation and the wave it has brought with the changes on what we are watching on tv.

Reality television shows are giving people a sense of a false, glamourous lifestyle. They appear on tv showing off their money and prized possessions making people feel that it’s ok to not work and make fast money. They see their favorite reality tv personalities doing it every day, so it has become common and ok to follow these people and look up to them. Making children and young adults feel they can attain those same lifestyles by doing moronic things, and “jokes” to get a few likes, longing to be part of some reality tv show, in the hopes of getting famous and making a lot of money. What most of regular people fail to realize is that they get you by showing you all the glitz and glamour that comes with life in the spotlight so that you as an individual want to follow the most recent trends and go spend your money on what products they endorse with the intention of them making millions off people who follow them. People lose the sense and value of what hard work really is because reality tv makes it seem easy, as in encouraging the masses to get on tv say and do a few tasteless jokes or acts and POW... your famous! If things really were as easy as they make them out to be, I think we would all opt for reality tv careers, but there is much more life and substance to working hard for whatever things you may want to achieve in this life. Most people who participate in reality tv come off ignorant, lacking substance, life goals, and basic human morals. Making them the least suitable models for younger audiences, yet such individuals are often held in high social regard and are even considered celebrities holding influence upon the millions of viewers that follow these brash, distasteful forms of entertainment, the majority of whom are young children and pre-teens.

Reality tv can range from real life people in unsafe or foolish situations, celebrities, dating, and the popular teen pregnancy shows. For example, if you look at how much time the average individual spends watching these shows and the time, they spend doing productive things such as spending quality time with family, teaching something productive to someone younger, going out for a walk, reading a book. Most people turn on the tv for their children without supervision with the hopes of entertaining them and keeping them quiet for a while, but fail to realize that by letting them watch tv with no restriction children are vulnerable to have their self-esteem hindered because they cannot perceive the true nature behind what they are watching. Young teens watching teen pregnancy shows with young mothers making it seem like beinga young mother is “cool”. They appear on these shows with their babies well dressed, going on vacation and enjoying things that sadly most pregnant teens can only dream of, making other young teens think that that it is acceptable and empowering to be a teen parent. Yet they fail to truly examine the real cost of being a young parent and of having the very real task of caring for another living being. They have no education, little to no money, and often no place to live because they are young parents with no experience.

Most of these teens make money by participating in the show but not all young teen parents are fortunate to be able to make it to these shows and provide accordingly.Now a days it has become more apparent than ever that everyone wants to shove their ideas, and ways of life on others. I believe in mutual respect and in the essential freedoms of everyone, but that does not mean that I must accept everything that is being presented to me. People are so infatuated with making othersaccept their ideas that they will go to any lengths to make you believe a distorted reality. By watching reality tv, you as a person are accepting and encouraging the stupidity that people inflict on to themselves and others. People being violent towards one another, jealousy, spite, lies, sex, and drugs are the most prevalent ingredients of reality tv, and the list goes on because there are no boundaries that are being set to what is being aired on these reality tv shows. Being relatively unregulated allows these programmers to flood the airwaves with dozens of these shows seemingly at will, making such programming grow in demand and popularity being shown in nearly every major channel.I remember when Jersey Shore came out making everyone think that being at the Jersey Shore was the “cool” thing do, being drunk, belligerent, and tacky was a recipe for success for the cast of Jersey Shore proving yet again that ignorance has a magnet effect, yet people are unable to look away. It is as if people are drawn into the lives of these reality stars and the reckless lives they portray.

The effects of reality tv have seeped through the ranks from influencing your common man and even many stars and athletes who are also opting to star on reality tv shows.Another example would be the “Kardashians”, a family who built their name by parading their personal lives to the public, having many younger viewers specially girls idolizing them wanting to look, sound, and act like them. It seems like now a day everyone on social media looks like a “Kardashian”, some even following in the steps of these so-called reality tv stars. If you have a young child, I don’t think that watching people who made their family name famous by scandals is a good example for a child or anyone in that matter. The family has pushed their ideas on how people should look, dress and sound like via their reality tv show, and other social media.The power of reality tv does not stop there its influence spreads like a virus going as far as changing the pillars of society itself, making people hollow and superficial by making people believe that looks or a willingness to be humiliated are a viable way of making it in the real world. As well as bombarding them with constant reminders that one can never look or be good enough putting more value into meaningless and mundane things, as well as putting everyone in a constant state of competition. Never satisfying or fulfilling the individual and always wanting to outdo one another, it is this shallow mentality that’s a direct cause of people becoming more selfish and only looking to their own gain. Ignorance has replaced the voice of reason and unnatural behaviors and what’s often considered taboo is now becoming normalized and being praisedas empowering.

In conclusion, the examination of reality tv is important as its effects are felt by people of all walks of life and social standing, it is a growing tumor in our society and its only getting worse. Reality tv will not be eliminated,or done for overnight but in the end, it is up to the individual to determine what they see and what they allow to exert influence over them, and most importantly their children. Common sense and a bit of taste are all it takes to not be sucked into the funnel of ignorance. At the end of it all a person is only what they know and project.

Washington Irving Works Analysis

Most people think of the characters from the short stories “The Legend of Sleepy Hollow” and “Rip Van Winkle” when they think of Washington Irving. They envision a headless horseman with a pumpkin for a head riding his ghostly horse through the forest or maybe a little old man waking after a long, deep sleep with a very long, fluffy, white beard. While those are the stories he is best known for; there is much more to the works of Washington Irving. He created a literary tradition through stories that used humor to point to deeper meanings and he had a literary life that cultivated his deep imagination.

Irving’s first book was A History of New York is derived from a handwritten manuscript by Dedrick Knickerbocker that he left in an imaginary hotel room. It tells the history of New York from the beginning of the world until the end of the Dutch Dynasty. Knickerbocker was one of many pseudonyms used by Washington Irving. It is obvious that the author has an interest in the customs and history of the people and families of New York. According to the book, the manuscript is composed from information received through answers to classified ads Knickerbocker placed in a New York newspaper asking controversial questions. It is a comical tell of well-to-do families in New York. It was in A History of New York that the city was first referred to as Gotham.

Several wealthy families actually tried to sue the publisher, but to no avail. They seemed to believe the storyline was too closed the the truth. A History of New York reveals the complexity of Irving’s imagination. Consider an imaginary manuscript based on imaginary classified ads written by an imaginary author, found in an imaginary hotel room. All written about imaginary families in New York.

The Sketchbook of Geoffrey Crayon is a collection of short stories including “The Legend of Sleepy Hollow” and Rip Van Winkle. These two stories are responsible for the beginning of American mythology. Geoffrey Crayon is another of Washington Irvin’s aliases. One of Irving favorite places when he was young, was the Hudson River Valley. It was the inspiration for parts of Sleepy Hollow. It is easy to compare Irving to Ichabod Crane. Both are nervous and have a tremendous fear of women. Many of his works of romantic fiction were written to attract the attention of the young ladies. Irving put a lot of effort trying to be liked and accepted by American culture and the political world. Irving finished The Sketchbook of Geoffrey Crayon in 1820 just as America was becoming a republic after the War of 1812.

Irving’s own notes show how he copied German folktale elements the one day made their way into “Rip Van Winkle”. Rip Van Winkle was in a deep sleep for a very long time waking to historical changes. The story reflects the influence of German storytellers such as Peter Klaus. “Rip Van Winkle” to this day remains one of the most influential stories in American History. Irving’s stories tell off the foundation of America and the bringing of nations together through storytelling. His writings represent the past and offered romanticized observations and conversations. He wrote under many pseudonyms, the first being Jonathan Oldstyle. It was the name he used while writing theatre reviews in his brother’s paper The Morning Chronicle. He wrote popular biographies of George Washington, whom he was named after, and Christopher Columbus. In both England and America, Irving’s literary works became so popular that he became the first American author to classified as rich.

In the 1850s American was nearing the beginning of the Ware Between the States. It was around that time that he wrote Our Old Home. It is about interaction with the “mother country” rather than showing England as a threat to America’s identity. Irving was reexamining his English ancestry and wrote for readers that were not familiar with London. In 1826, Irving was recommended by Daniel Webster for the job of consular in Madrid, Spain. This inspired him to write his works of fictional history about Spain. He remained in Europe for almost twenty years. He loved Europe and cherished the time he spent there, but he knew when it was time to return to America. He returned to America in 1853 and began writing about the wild West. He wrote a trilogy of Westerns: A Tour of the Prairies, Astoria or Anecdotes of an Enterprise, Beyond the Smokey Mountains, and The Adventures of Captain Bonnaville, U.S.A. He wrote about the hostility between the Native Americans and the settlers that were moving further and further west. He wrote stories that covered topics like the Mexican-American War, the California Gold Rush, and the Transcontinental Railroad.

Irving’s western books were filled with Indiana Chiefs and warriors, ships’ captains, Chinese merchants, and Scottish tradesmen. He placed battles and determination and the center of his westerns. His books made history not only educational, but interesting and fun to read. A Tour of the Prairies was like a wonderful guidebook to a beautiful west. It described landscapes with such detail the reader could see it as it was being read. Step by step details describing a hunt and colorful descriptions of the frontier characters. It could be take the reader on an adventure to places through the detailed descriptions of places and situations. He projected Native people as either noble of comic buffoons. One of Irving’s most important westerns is Astoria or Anecdotes of an Enterprise. Astoria is a history book published in 1836 and details the struggles between American and Great Britain. At the time it was even required reading in some schools.

Washington Irving died in 1859 while proofing Volume V of The Complete Works of Washington Irving, Volumes I - V. 533 pages of Irving’s original manuscripts are missing. Irving’s works tell of the founding of America and the bringing together of nations through storytelling. The introduction to The Complete Works of Washington Irving, Volumes I - 5 states that Irving got much of his material and information through interviews with survivors that lived through the history about which he wrote. Irving is revealed to be to be a hallowed but imperfectly known man who is a complex and sympathetic human being. The most recent portrait of Washington Irving paints a picture of a man that is flawed and conflicted. His works however are recommended for public and academic libraries. Stories such as “The Legend of Sleepy Hollow” and “Rip Van Winkle” are timeless and just as entertaining today as the were when they were written 200 years ago. Most likely they can be found in any library. Washington Irving (1783 - 1859) was a literal genius. Over time, he is still considered the Father of American Literature.

“Rip Van Winkle” Summary and Analysis

“Rip Van Winkle” is a short tale written by Washington Irving in 1819. Irving was a famous man who wrote so many stories including satirical essays, biographies, sketches, tales, poems and publications in different magazines (Salmagundi with his brother, as an example). One of his aims during his life was to divulge some beliefs or movements of his time through fiction. As we can see, “Rip Van Winkle” is a good example of this because he plays with the formation of Unites States of America after the American Revolution.

Irving also was the first American writer of the 19th Century to achieve international reputation and it is also important his consideration as a pioneer of the short story in this centenary.

Firstly, I am going to summarize briefly this tale. Irving describes in third person the biography of Rip Van Winkle, “a simple good natured man… obedient, henpecked husband” (Irving, “Rip Van Winkle”) who lives in a province when the country was yet part of Great Britain. He is loved by all the wives of the village, children, and neighbors but not by his own family; especially by his wife. Dame Van Winkle can be seen as his antagonist: she is upset and screaming all the time because Rip and his laziness. She cannot understand how he can be ready to any business if it is not to his own. Likewise, she is never in peace and tranquility as his husband. All these marital problems are consoled by Rip going to a club of philosophers on a bench which has a portrait of George the Third. It was controlled by an important man in the village called Nicholas Veder. Besides this activity, he used to go to the mountains with his gun and his dog called Wolf. One day, Rips meets a strange man because he was calling his name with shouts in the middle of the woods and Rip goes with him into a crew where drinks a strange liqueur with a lot of weird and exotic people. After this, he fall asleep during twenty years and when Rip awakes he discovers that his gun is different and his dog is not there. He is really worried about what her wife is going to say to him because he has been out a long time although he does not know how long has it has really been. He comes back to his village and he sees how everything has changed as the time has gone. Not only his own environment had become different but his society too: Dame Van Winkle had broken a blood vessel and died, some friends died, and his dog had forgotten about him.

Even the neighbors pointed a man who looks exactly like Rip when he had gone to the woods.
At the beginning he was totally disoriented because even the buildings were totally different: his own home, all the houses, his old inn resort was gone and now it was called “The Union Hotel, by Jonathan Doolittle” and the King George portrait was with a lot of changes, like metamorphosed and now there is one of General Washington. Thanks to an ancient in the village who recognized him everyone accepts him again; even his own daughter called Judith Gardenier. Thereby, Rip lived now with her child and started a new life “having nothing to do at home, and being arrived at that happy age when a man can do nothing with impunity”. The end of this story shows how he had now got rid of his difficult marriage and was a quiet man again without the weight of a tyrannical woman by his side.

Now I am going to analyze this story making a comparison with the famous American Dream. The American Dream is a national ethos of the Unites States which represents the belief that everyone in the US has the chance to be successful and happy if they work hard (Cambridge Dictionary) .It is not a dream of motor cars and high wages merely, but a dream of social order in which each man and each woman shall be able to attain to the fullest stature of which they are innately capable, ... regardless of the fortuitous circumstances of birth or position (Adams, Epic of America).

As we can see, Irving in this tale is satirizing this belief: Rip gets the life he had dreamt without any effort, he simply loses twenty years of his life for having accidentally drunk that liquor in the woods. However, the story is clearly a representation of the American dream that comes after those twenty years of Revolution.

We can see the before and after of this Revolution and how everything has changed. A new society is developed through freedom during these years of Revolution and we have some examples of this. The first is the portrait of The King George the Third which has been removed and now there is one General Washington's representation instead of it.

The second is how the people from from the village (recent Americans) are speaking under it about the new government and all the opportunities that the American Revolution has brought to this village “The very character of the people seemed changed. There was a busy bustling, disputatious tone about it, instead of the accustomed phlegm and drowsy tranquility” (Irving, “Rip Van Winkle”).

The third is the freedom that Rip Van Winkle feels because of the death of his own wife. In my personal opinion, this marital relationship represents the fight between Great Britain and the colonies during the American Revolution. The colonies do not want to change but Great Britain forced them to follow and love the homeland. We could observe a representation of Dame Van Winkle (homeland) and Rip (the colonies that were unpleasant with Great Britain). Also the fact that the time before the revolution was a hard time as the matrimony of the protagonists of this short story.

I have focused too in how Irving praises the “majestic” mountains of Kaastskill which Europe lacks. Nevertheless, the use of these ancient explorers into Rip Van Winkle only to show that although America has formed its own identity, no one can break its connection with Europe. No matter when America was still under tyranny of the British rule, some people still cannot cut the blood relationship with Europe. Hence, America is like a child that has been born, a new identity that has been created but always with lines that unites it with the European community.

As a conclusion and to finish this essay I am going to say that all of these story's facts show us Rip as a non-successful and non-prototype dreamer. He does not work hard for anything and he becomes happy only because he can be as lazy as he has always been. Thanks to the death of his wife he can live that life he has always dream about: “he had got his neck out of the yoke matrimony, and could go in and out whenever he pleased, without dreading the tyranny of Dame Van Winkle” (Irving, “Rip Van Winkle”).

Rita Hayworth and “the Shawshank Redemption”

People say that comparing this movie and the short story is like comparing a warm chocolate chip cookie and a hot brownie. The movie follows the book closely in relation to the characters and plot but includes some significant changes. Stephen King’s novella “Rita Hayworth and the Shawshank Redemption” tells the story of a prisoner named Andy Dufresne, who is sentenced for life for the murder of his wife and her lover. Even though Andy did not commit the crime, the evidence was not in his favor. The story chronicles his time in the Shawshank Prison is recorded by Red, his friend, as a memoir. In 1994, director Frank Darabont released a film entitled The Shawshank Redemption that adapted this novella. The major change in the movie happens with the narrative perspective. The movie changes Red’s first-person perspective because it removes Red’s bias which allows viewers to have a deeper understanding of the tragic natures of the characters and value the hope Andy brought more.

A perfect example of the narrative perspective would be the film’s expansion of Brooks character. In the story, Brooks Hatlen is a "tough old con...sixty-eight and arthritic". Brooks had been in the prison since 1909 and was the only prisoner aside from Andy Dufresne who had a college degree. He worked in the library of the prison and was respected by others. He was also the first person in the movie who showed humanity inside the cold fence of Shawshank when he asked the maggot for the crow in his pocket. Brooks was terrified of the fact that he is going out to a world that he knows nothing about and even threatens to kill Heywood, a fellow prisoner, in order to stay in prison. The final scene of Brooks begins with him leaving the Shawshank State Prison through the large black gates, with the prison officers kindly acknowledging him, and wishing him well for the future. The framing of this shot allows Brooks to walk towards the audience as we see his vacant and hopeless facial expression, signifying that he does not know where to go, even though he has just become free. The decent reputation he has in the prison was gone with the wind after he was released. Brooks is institutionalized. He constantly wakes up at night and wondering where he is. The cars on the street scare him and soon enough it became too much for him. In the novella, his final letter showed his state of mind: “The world went and got itself in a big damn hurry… I don’t like it here… I’m tired of being afraid all the time … I’ve decided to not stay.” The institutionalizing of the prisoners at Shawshank takes away their hope by removing their right to make decisions. With Brooks, it took his freedom outside of the prison. News of Brooks’ suicide effects the prisoner’s desire, especially Red, to leave or escape the prison and perplexes them about their own fate, which instills fear and anxiety about the outside world. Comparing the letter to how Brooks died in the movie, the director not only adds drama to the plot but also directly sends a message to the viewer to emphasize Brooks’ helpless and uncomfortableness in the outside world, which we would not see through Red’s narrative.

Tommy is another tragic figure in the story who again emphasizes the ruthless and cruelty of Shawshank’s environment. He arrived in Shawshank on a two-year term for stealing TV sets from JC Penny. “We liked him immediately,” Red says. Tommy brought in key plot information when he reveals that someone else probably killed Andy’s wife. In the novel, Tommy is offered a deal by the Warden to be transferred to Cashman. The condition is that Tommy will not divulge the details of Andy's case anywhere which he accepted. Tommy’s life ends in a much more dramatic way in the movie. The Warden calls Tommy in the middle of the night and asks him whether what he said to Andy and Red was true. When he answers affirmative, the warden gives a signal to Captain Hadley to shoot Tommy from a tower. Four shots ring out and Tommy falls to the ground dead. Andy was thrilled about the information that someone else killed his wife and her lover; however, the warden declined his request for appeal and then informed him of Tommy’s transfer after his stint solitary.

Warden’s attitude triggers Andy’s rebellion. Andy threatens to stop helping Warden Norton with illegal transactions, but the Warden tells Andy that he would do the hardest time there is if he does so. The Warden portrays himself as a strict Christian, but he has no problem with ordering Captain Hadley to beat any inmate. The Warden believes in two things: “discipline and the Bible”, and that the prisoners will receive both. The Warden made sure that he is the “God” in the Shawshank by controlling inmates’ lives and freedom. This characteristic of him directly caused the death of Tommy. The novella instead did not mention Tommy’s death. King’s passage mainly focused on how hopeless Andy was after he lost his only chance to prove himself innocent. Director Darabont adapted the three wardens in King’s novella into one corrupt and heartless warden and exposed the darkness of humanity to the audience though the Warden and Tommy’s death. The Shawshank is dehumanizing people both mentally and physically.

Even though the director changed the narrative perspective of the movie, it is still essential to have Red serve as the film’s narrator. Voiceover narration in cinema can be an enabler for indolent and lazy writing, it lets stories tell us how a character feels instead of portraying it believable. But when used appropriately, as in The Shawshank Redemption, the effect can be brilliant. Red’s first-person voiceover in The Shawshank Redemption speaks directly to the audience. The first passage he says is “I am the guy who can get it for you,” bringing the viewer into the film. As he narrates this information, the film shows him slipping a fellow inmate some smokes establishing a friendly tone that carries through the film. Red’s words are not just convict-talk, the language is almost poetic. First-person narration allows the story to unfold smoothly as it depicts a longer passage of time and adds extra layers of observation and feeling to scenes. The narration does not tell the story, it comments on the story already being told through visuals. Darabont made the right decision in leaving part of Stephen King’s original narrative in the story because Red’s likability gathers sympathy for the other characters and Red himself was effectively affected by Andy’s positivity. Red was scared of the life outside of Shawshank and Brooks’ death concerns him more. With Red’s voice over, the audience relates themselves easily to Red’s mental journey of becoming hopeful to the future life which a crucial aspect of the movie.

First-person narration reveals the limits of individual perception. Therefore, director Darabont changed the movie into the third-person perspective and expands the characters, Brooks and Tommy, to further describe the brutal environment of Shawshank. Brooks, an inmate who has been in prison for fifty years was institutionalized by the end. His death exposes how mentally the prison dehumanizes people. Tommy, an innocent man who is killed by the Warden and the Captain for his loyalty to his friend, in the movie allows the audience to realize Shawshank is lawless. The officers and the Warden control death. However, the director kept most of Red’s narration. By doing so, it conveys important insights into the narrator’s character which is Red’s mental transformation. Andy’s positivity under the ruthless environment inspires Red and the fellow inmates and was shown thoroughly in Red’s narrative. All the changes Darabont made for the film are to better serve the theme of the movie, hope. Without realizing how cruel Shawshank is, the audience would not understand how precious Andy’s hope is.

Red and Andy in Shawshank Redemption

Red, the narrator, recounts how he planned and carried out his wife’s murder by disabling her brakes, which accidentally killed a neighbor and child as well and earned him a life sentence at Shawshank Prison. Red also remembers the arrival of an inmate named Andy Dufresne, whose tenure at Shawshank affected the lives of everyone at the prison. Andy was sent to Shawshank for life in 1947 for the cold-blooded murder of his wife, Linda, and her lover, tennis pro Glenn Quentin. Despite the damning evidence placing him at the scene of the crime on the night of the murders, Andy has always maintained his innocence, which Red eventually comes to believe in as well.Andy has some initial difficulty adjusting to prison life, especially because many of the other prisoners think he’s a snob. A gang of men known as the Sisters frequently attack and rape him in the laundry room while the guards look the other way. Andy fights the Sisters, even though it always lands him in the infirmary and sometimes solitary confinement. Despite these hardships, however, Andy never complains or loses his confidence.Soon after arriving at Shawshank, Andy approaches Red and asks him to procure a rock hammer because he’s interested in rock collecting and carving. After a while, he also pays Red to smuggle in some polishing cloths and then, rather nervously, a large poster of pinup Rita Hayworth. Red fulfills Andy’s requests.

After a few years, Red and Andy both find themselves on a work crew, tarring the roof of the prison’s license plate factory. Andy overhears Byron Hadley, a prison guard, complaining to the other guards about the taxes he’ll have to pay on the $35,000 he just inherited from his long-lost brother. Andy offers Hadley some financial advice by telling him to give the money to his wife as a one-time tax-free gift. Andy even offers to fill out the paperwork for Hadley in exchange for giving three beers to each prisoner on the work crew. After some initial hesitation and suspicion, Hadley agrees. The deal wins Andy the respect of everyone involved and makes him a mythic hero in the eyes of the prisoners. Andy also becomes a valuable financial resource to those who run the prison. As a result, the guards and the warden protect Andy from the Sisters, make him the prison librarian, and don’t assign other inmates to his cell. Andy relishes his new position and works hard during the next two decades to significantly expand the library.

As coming to the review this irrepressible, inscrutable short story by Stephen King is about bad people who are sort of really good people, and sort of good people who refuse to let really bad things become their way of life.Red is a murderer, but we get past that in the first pages. Red is the philosopher-king of Shawshank Prison. For my money, Red is the point of the story. We know he’s innocent, we know he is cruelly and unjustly entombed and forgotten in hell, we know what he does in Shawshank, we admire his motivation, and yet we know the man only as Red knows him. Red is a passive observer, attentive to be sure, and responsive to Andy’s intellect and his bulldog determination, but Red never penetrates Andy’s mind, never really understands Andy’s private self.For me, as for Red, the man Dufresne has a full-length poster picture of himself taped to the top of his head, and we never are able to get behind the poster and get in to the real Andy.

The Unpaved Path for Sherman Alexie

Sherman Alexie was born on October 7th, 1966 on an Indian Reservation in Wellpinit, Washington. He is a member of the Spokane tribe which is a major influence on his work and his first hand experiences has made him a notable author. In his early life, he was operated on to treat hydrocephalus that he was born with and had a slim chance of survival. However, he did not let this condition bring him down, “Though he lived through the experience, he was plagued with seizures as a child and spent most of his childhood reading.” (Poetry Foundation). He then found great success throughout school leading to his attendance at Jesuit Gonzaga University. The success at Jesuit Gonzaga became short lived, “...he had a successful academic career but began to abuse alcohol.” (Poetry Foundation). He then transferred schools and later became sober.

In fact, Alexie was robbed on his birthday. That is where he was at his lowest and began to focus heavily on school at Washington State. When a turn of motivation in what he wanted to be, “he signed up for a poetry class, hoping to write sonnets to impress girls. He had no idea that his professor, Alex Kuo, would radically rechart the path of his life.” (Cline). Alexie’s professor made him read about poems from Native Americans, Alexie had these experiences that were written about and wrote about them himself. From there, Alexie began to write legitimate poems about Native American life and later shifted focus to short stories and fiction.

Growing up on an Indian Reservation gave Sherman Alexie has seen what most people have not have. He tells what it is really like on an Indian Reserve and the problems Native Americans face. Poverty is the most prevalent issue and Alexie’s stories have a sad tone and make readers feel sympathetic at times due to the fact that Native Americans do not live the best lives. “This Is What It Means to Say Phoenix, Arizona” is a short story that Alexie wrote. It is about a Native American man named Victor who had just been informed that his father died. Victor then has to go to Arizona, which is a struggle financially, but he goes with the help of his friend Thomas.

I asked Victor, “How did you feel when you learned your father died and what was your first course of action?” He replied, “Well, my father and I were quite distant but I knew I had to go to Phoenix because he was being cremated. But it immediately struck me that I needed money to fly to Phoenix ,I had just lost my job too, and money is very tight for everyone on the Reservation. Luckily the Tribal Council can help me with situations like this.” “How much did the council help?” I replied. “I was shocked when I heard the amount they offered to give, It did not help much at all. However, my long time friend Thomas knew I was in need and offered to help me with the rest of the money. He also went on the trip with me.” Why did he help you?” Victor said, “Thomas Builds-the-Fire is one of my oldest friends, we grew up together but grew apart as time moved on, he is a storyteller that nobody really listens to. He knew about my father before I even told him, I feel bad but I felt embarrassed talking to him in front of everybody. He really helped me out though, I am very appreciative and now I cherish the stories he told and rekindled our friendship, he taught me so much about myself.” “What a great story.” I said,Victor told me about the things that go on in Indian Reservations and the importance of relationships.

The Pit-bull first originated back in the early 1800’s in the United Kingdom. Pit-bulls originally were first bred by using the Old English Bulldog, which is similar to what they call today’s American Bulldog. Pit-bulls also gained their popularity from a cruel and deadly sport held in the British Isles called bull baiting. Bull baiting comes from a event that used to be held by the British were Pit bulls would be set out to fight bulls until either or both were tired or injured. Some feel as if Pitbulls are just dangerous and vicious animal that have lockjaw's and a uncontrollable amount of aggression, while this could be true depending on how you train your dog their is also another side to these loyal animals that radiates protection due to their love for their humans. But behind the breed are many myths and legends but to determine an opinion we need to turn to fact and reality.

One point of controversy is whether a dog as an individual should be classified as dangerous or vicious due to the basis of its breed. Aggressive behavior and dog fighting have been the main factors of emphasis associated with the breed pitbulls. These bans stem off the core belief that the breed is unpredictably and inherently dangerous and vicious. So are pit bull breed as a whole actually dangerous and vicious? The spruce pets research discovered some of the following factors that influence aggressive behavior of any breed. “A dog that was deliberately bred from a line of aggressive dogs is more likely to have natural aggressive tendencies. A dog that is never properly socialized is more likely to be aggressive. A dog allowed to roam free or left chained up and alone is also more likely to develop aggression. Intact male dogs are statistically more likely to show aggression towards other dogs.” When forming an opinion based off fact and knowledge you must observe the following factors. Due to the sad fact that pitbulls are often owned by irresponsible people who only wish to earn profit off of illegal fighting, using the breed as guard dogs, or to even toughen up their own images has resulted in the notorious storm in creating aggressive dogs.

Many of the factors that affect a dog's demeanor depend on humans. Humans are responsible for proper training, socialization, and the "quality of ownership and supervision" of the dog. Moreover, the legislative history of pit bull bans also recognizes these human factors are one of the major contributors to the aggressive side of the animal. Opponents of BSL feel that the banning of breeds will not correct the problem. The solution lies in the prosecution of bad owners as well as educating the public. Pit bulls with responsible owners are not classified as dangerous, in fact, many are affectionate companions. It’s important to emphasis the loyal side of pitbulls. People tend to overlook how protective pit-bulls are towards their respected owner. Pitbulls are one of the most protective kinds of animals. A Pit Bull will do anything his people ask just to hear their praise. These dogs crave our attention and approval. This devotion to people has contributed heavily to the bad reputation of Pit Bulls, because a bad person can use a Pit Bull’s eagerness to please to train the dog for nefarious or criminal purposes. Pitbulls only want to please us, therefore resulting in such loyalty.

So should pit bulls be banned? Most supporters of Breed Specific Legislation (BSL) hope to see all pit bull-type breeds banned. They believe that all pit-bull dogs pose a risk. Opponents of BSL feel that the banning of breeds will not correct the problem. Instead, the wrong people will still find a way to get the dogs or they will simply move on to a new breed/type of dog. ASPCA feel “the solution lies in the prosecution of bad owners as well as educating the public.” It is important to know that pit bulls with responsible owners are in fact not dangerous dogs, but affectionate companions. Dangerous dogs come in all shapes, sizes, and breeds.

I’ve come to the conclusion that I can’t blame pit-bulls for their actions because it’s not a pit-bull problem it’s a people problem. If we the people would properly train and take care of not just pit-bulls but all dogs there will be less violence and aggression towards humans and even other pets. How ever you treat animals is how they will treat you back. As a male college student who has grown up in America, the banning of pit-bulls in cities and states has grabbed my attention because it’s coming closer to home. Growing up I've always been around various breeds of pitbulls. Though I have never owned one because of my mother's personal opinion due to this controversial issue, I am certain that the pit-bulls I encountered weren’t dangerous. I remember dog sitting pit-bull puppies for my cousin and I never forgot how much I fell in love with this special one of a kind dog. My love for Pitbulls is so strong that my freshman year in high school, the summer my family were looking to add a pet to our family, they overlooked the pitbull for sale and in return resulted in me weeping. “All dogs, including pit bulls, are individuals. Treating them as such, providing them with the care, training and supervision they require, and judging them by their actions and not by their DNA or their physical appearance is the best way to ensure that dogs and people can continue to share safe and happy lives together” says the ASPCA.

I rest assured, strongly believing that these loyal animals deserve the chance to unveil their caring nature and loyal personalities despite their well known past history of aggressive nature.

Pit Bulls – a Misunderstood Breed

Pit bulls are a misunderstood breed because of irresponsible owners and biased news stories, but their history, interactions, and temperament prove otherwise. Breed specific legislation has been introduced in cities across the United States that either restrict or ban pit bulls as pets. One in four animals brought into shelters are pit bulls, and their euthanasia rate averages at 93 percent. My brother has owned a pitbull for the last 12 years. She is the goofiest, sweetest, and most spoiled dog I think I’ve ever met. And trust me, I have a spoiled brat of my own. Although she is a huge part of our family and my mom’s first “grand-dog”, she has suffered through her fair share of discrimination. She has always interacted and played with other dogs, and has never strayed from her gentle nature, but a few years ago, she was on a chain in my brother’s yard, when 2 dogs ran into the yard and attacked her. When she began defending herself, one of the other dogs was minorly injured. The neighbor who owned the dogs took my brother to court, trying to argue that she was aggressive and dangerous and should be euthanized. Again, she was on a chain and his dogs attacked her, and her injuries were much worse than the other dog’s. Luckily, my brother had a security camera that caught the whole incident and proved that she was not at fault, which saved her life. Other dogs like her have not been so lucky.

Pit bulls haven't always been a feared breed. During World War I, pitbulls represented America on army recruitment posters, and many pit bulls became famous in the military. The U.S. admired this breed because they are friendly, brave, hardworking, and respectful. Unfortunately, people have found ways to exploit pit bulls for dog fighting, and their muscular appearance became a symbol of violence. Pitbulls were first recognized by the United Kennel Club as the "nanny dog" for children because of their friendly nature, loyalty, and stability. The ASPCA argues that pitbulls were "once considered especially non-aggressive to people” but since the 1980s, the media has created a false image that shows pitbulls to be more dangerous than other breeds. There is actually no factual information that supports this claim, and according to the American Veterinary Medicine Association, "studies have not proved this breed to be extremely dangerous."

Karen Delise, the research director for the National Canine Research Council and author of The Pit Bull Placebo, has researched hundreds of serious dog bite incidents and states, “My study of dog bite-related deaths that have occurred over the past 50 years have proved that poor ownership practices account for a majority of these incidents, such as negative human interaction; owners failing to humanely contain, control, and maintain their dogs; owners failing to supervise interactions between children and dogs; and owners failing to spay or neuter dogs.” Experts also say that pitbulls are the most often abused, tortured, abandoned, and euthanized breed in the United States.

The American Temperance Testing Society tests thousands of dogs each year. The dogs are tested for skittishness, aggression, and their ability to determine the difference between threatening and non-threatening humans. Of all the breeds that were tested, pit bulls showed an above average temperament, with 86 percent. Pitbulls are the second most tolerant breed tested, behind only golden retrievers.
Aggression is not a breed, it's a state of mind, and a dog’s temperament is a direct result of the care and training that it receives. Pitbulls’ history, interactions, and temperament prove that this breed is no more dangerous or deserving of this unnecessary hatred than any other breed. Today’s society should learn to look past the stereotypes of pit bulls, because every dog deserves love, all shapes, sizes, and breeds.

Pit Bulls: Are They the Problem, or Are We? It’s hard to conceptualize something as coming home from a night out and finding that your precious 5-month-old baby girl had been mauled to death by a dog you knew and trusted so well. The very dog that was like family, eating dinner at the table, checking on the baby often, and sleeping near her as if to protect her over her short, but entire life.

As difficult as it is to try and imagine, this was a reality for the family of Paige George, the young victim of the canine attack. It was a seemingly normal night as George’s babysitter put her down for her bedtime. He then went to bed himself, leaving the baby on a bed in a room of the Atlanta, Georgia, home. When Paige’s mom came home, she found her baby dead. The dog most people would picture in a story such as this one would be a pit bull, a dog well publicized for its aggressive and violent nature. However, the dog responsible for this horrific incident was actually a German Shepherd, generally a loving and loyal companion (Sokmensuer). There have been instances where pit bulls have attacked and hurt people, but we know how dangerous stereotyping is, so why do it to an entire breed of dog that people think is dangerous based on news stories, especially since they are sometimes sensationalized to make the breed look even more alarming.

This animal, the pit bull, characterized by many as the most heinous model of all dogs, has been given a terrible and seemingly unchangeable reputation for violence. Even though there are instances where this type of dog acts violently towards people, the whole breed shouldn’t be reprimanded. Not every dog characterized as a pit bull is even a pit bull. Not only that, the term pit bull is in and of itself not a correct way to characterize these types of dogs. A “pit bull” is not actually a breed of dogs, it is the overall term for a few different breeds (Greenwood). “...'pit bull' is a 'type’," Dickey said. "Within that type, there are four distinct pedigree breeds: the American pit bull terrier, the American Staffordshire terrier, the Staffordshire bull terrier and the American bully" (Greenwood).

People see any dog that looks as if it could be a pit bull and call it a pit bull. However, there has been lots of research on breed identification that has displayed how often it occurs that dogs that look like pit bulls don’t even have any pit bull in their genes or DNA (qtd. in Greenwood). It has also been proven that two animal specialists can be shown a photo of the same dog and not settle on what breeds make up the dog. Because of this, it is inferred that a broad number of dogs that are classified as pit bulls are simply mutts and not at all pit bulls (qtd. in Greenwood). So, the whole breed of pit bulls are being given a bad name because of how uninformed today’s society is on this category of dog. There are stories everywhere about the malicious actions of these creatures when it’s very possible as we now see that people are just talking about the wrong dog. Besides the miseducation of the absolute facts of the pit bull, the dog’s history has played a role on the way they are portrayed in today’s world. “For two thousand years or longer, pit bulldogs have been bred for a single purpose- to fight… To attack anything with four legs.” (qtd. in Dickey).

In the early 1800’s, pit bulls were bred from old english bulldogs to participate in a sport no longer played, called “bull baiting” (The History). This game consisted of one or two Bulldogs who were appointed to attack a bull for as much time until it succumbed. It was a game created to entertain the members of the lower classes who were having a hard time and needed a foundation of alleviation (The History) . In the times of WWI and WWII, pit bulls became America’s mascot. “Their image of bravery and loyalty was displayed throughout advertisements during war time” (The History). At this time, everyone loved pit bulls, they were the friendly companion dogs that America loved so much. However, with the rise of the media these dogs were running out of luck (The History). It’s difficult to trace back to the exact moment when pit bulls became one of the most feared dogs but a magazine cover story identified as “The Pit Bull Friend and Killer” written in 1987 was a big part of the change in people’s view of this breed (The History). Various articles and stories were starting to be published about how dangerous the pit bull is and with barely any reason as to why. This is where the stereotype of pit bulls being the most violent and aggressive dog started to surface. People began to dump their pit bulls in shelters at an startling percentage and were “seen by criminals as items to be discarded” (The History). It almost seems like these dogs did nothing to influence the idea that they’re dangerous other than exist. Now, a way society has learned to cope with pit bulls and other supposed dangerous dogs is to ban them. Breed-specific legislation, or BSL is the name of the law that controls or prohibits people from owning certain breeds of dogs. It was created in an effort to lower the chance of dog attacks throughout the world (Breed-Specific).

12 countries have already banned pit bulls (Cannon). Media has had a partial impact on the way people look at pit bulls. (Cohen and Richardson 285). It would be no surprise that news platforms would prefer to only post stories of dog attacks with pit bulls because that’s the dog most people would expect (Glynn). The American Society for the Prevention of Cruelty to Animals, or the ASPCA, announced that media platforms have again and again stated they would rather only broadcast dog attacks where pit bulls or pit bull type dogs are involved (Glynn). Amelia Glynn conducted: [A] quick search in the Chronicles archives for ‘dog attack,’ which yielded 34 stories about specific dog attacks on humans… While 22 of those articles mentioned the breed in the headline (100% named pit bulls as the attackers), the other 12 articles, which involved attacks by other breeds… had only generic ‘dog attack’ headlines… In other words, these media platforms used pit bull in their headlines when a pit bull was involved in the attack but when any other dog was involved, they used a collective title, like dog attack. People only want to read and hear about stories that include the breed they expect and that could be a reason all news media is negatively affecting these dogs.

The negative reputation of pit bulls has progressively gotten worse over time and it seems as if this breed will soon be gone with breed-specific legislation. Also, with news stories broadcasted mainly about dog attacks involving only pit bulls, the stereotyping won’t be stopping anytime soon. It’s certainly difficult to ignore the stories about the bites and the attacks, but how fair can it be to assume a dog is dangerous because you heard a story about a similar dog doing something threatening? Remember when that 5-month-old baby was mauled to death by the family dog that you most likely thought was a pit bull because of what you’ve been told and assumed about that dog (Sokmensuer). People like to ignore the fact that other dogs can be dangerous as well, and only look to blame the pit bull. Correlation does not equal causation.

Most the numbers i found about dog attacks are compiled from news reports, but the news doesn't cover every dog attack and in fact, there are no comprehensive numbers about how many people have been bitten by which breed of dogs. In the category against the dog’s aggression against other dog, pitbulls actually do score pretty high -- they’re more than the doberman, but less than the akita. When it comes to dog behavior the second factor is aggression towards people. And according to that same research, the dachshund and the chihuahua are really high, however the pitbull is more middle of the pack. The perception persist that they are highly aggressive dogs. ____ describes them as very sociable, affable, friendly and loving dogs.

All in all, pitbulls are middle of the road when it comes to aggression against people, but they're pretty high on the list on aggression towards other dogs, though they’re not at the top. And though they are big and strong, pitbulls don’t bite differently than any other dog.

I think they are the most misunderstood breed of dogs there is; they’re just dogs, they are not werewolves. There has been so much asteria involved with these dogs and so much media hype. Its one place where there probably is a lot of fake news. A lot of times they cant speak for themselves and we have to put the truth out there. I believe some of it is media bias. A dog that would attack another human being is a dog that is unstable and there a lot of dogs of any breed that are unstable just like there is people of any race that are unstable.

Analysis by the National Canine Research Council which is run by a pro pitbull foundation that claims there’s no reliable evidence that demonstrates a link between breed and fatal dog bites. They also claim that pitbulls are routinely misidentified as the guilty party.
I think responsible pet owners should be allowed to own whatever breed of dog they choose and it's that simple. No dog should ever be euthanized for what they are you can't generalize that pitbulls are not going to be good with people or kids.

Many people think that a pitbull is a specific breed of dog, but actually the term “pitbull” encompasses a variety of different breeds like the american bulldog, the american pit bull terrier, and the american staffordshire terrier. Unfortunately pit bull-type dogs seem to fall victim to negative stereotype arguably more than any other type of dog out there. One of the many reasons for the perpetuation of the myth that pitbulls are generally aggressive dogs is that oftentimes when someone does experience a dog bite and go to the emergency room, they either report that a dog bit them or a pitbull bit them and this causes emergency room medical records to be very biased against pitbull type dogs. Sketchy data like this has led to local, even national governments attempting to ban pitbull type dogs almost entirely, this is what's known as breed specific legislation. A study in the Journal of the American veterinary medical association examined dog bite related fatalities and found that breed was not a factor. For such reasons, the center for disease control and prevention, the American veterinary society of animal behavior and many other organizations have publicly opposed breed specific legislation as it does not help reduce dog bite incidents and deaths. In light of these countries such as italy and the netherlands, have reversed their breed specific legislation.

Pit bulls were originally created by breeding terrier dogs with bulldogs in order to combine the agility of the terrier with the strength of the bulldog. These dogs were used for such sports as bull baiting and bear baiting and then when those sports were outlawed, many people turned to underground dog fighting competitions because they were easier to conceal from law enforcement. while this certainly is violent history, it's important to remember that just because a dog can be trained to be violent, does not mean a dog is inherently violent by nature. As far as we can tell, pitbulls are no more likely to be born with an instinctive desire to fight than a maltese or a labrador is, more accurately, pit bulls are very often highly trainable, athletic dogs making them prime candidates to be exploited for nefarious activities. today pitbulls are used for so many positive things, they help law enforcement, they can make great therapy dogs and of course, they make wonderful pets. So with the violent image that people think of when they think of pitbulls isnt due to their natural temperament then why does this image persist? A study in the journal of interpersonal violence found that those who have high-risk breeds like pit bulls, rottweilers, german shepards, chow chows, and doberman pinschers have on average, 10 times as many criminal convictions as those with lower risk breeds. A more accurate correlation would be that those who are more likely to participate in criminal activity are also attracted to the negative stereotype of pitbull type dogs. It turns out that people are the problem, not the dogs and this is what the debate really needs to center around.

Silent Spring by Rachel Carson

Silent Spring by Rachel Carson is a 1962 environmental science book that follows Carson’s research on the environmental effects of the use of pesticides, focusing on pesticides that carried the chemical DDT (dichlorodiphenyltrichloroethane) that had been administered through aerial spraying, meant to diminish insect populations in 1950’s and early 1960’s. The book served Carson’s argument on how we are so set on desperately trying to sustain and control aspects of the environment that bother us or get in our way, we are ultimately destroying it as a whole. She also emphasized how these chemicals not only disrupted elements of nature, but how toxic and ineffective the use of them are in general.

The book begins with a made up tale of a seemingly environmentally perfect town, full of life and lavish in nature, but then out of nowhere mysterious illnesses start to be seen within the people of the town and animals. People are sick and dying along with plants and crops, rivers have no fish, birds are dying, farm animals stop reproducing, all due to the white powder that had been dropped over the town. Though this is just a fictional tale it is something that could happen in the real world. Carson then introduces real life pesticides showing how they work by her documentation of the toxic results from their use, and how the suppression (or attempt of suppression) of a species can negatively impact the rest of the ecosystem including humans. Silent Spring: Effect through the Legal System

The focus of this investigation will be, “To what extent did the book Silent Spring have an effect through the legal system?” and will analyze if this book had an impact on laws regarding the environment. The book Silent Spring primarily focuses on the potentially negative effects pesticides can have on the environment, and emphasizes the dangers of the pesticide DDT. Shortly after the book was published, Carson testified in front of a Senate subcommittee about pesticides, and argued that once these pesticides enter the biosphere, they not only kill insects, but through biomagnification can affect other species’ populations. This is also talked about and explained in the book Pesticides by Debra A. Miller, making these two sources crucial for this investigation.

This source could be of particular value to historians looking at this topic, because it deals with the topic at hand directly. Because this question pertains to this source in particular, it is essential for this book to be a main source, especially because it’s a primary source. Before analyzing if Silent Spring has had an effect through the legal system, there needs to be a complete understanding of the premise of the book to begin to comprehend why it would have enough of an effect to do so. This book is also educational in two senses; it’s educational in the sense of providing facts and case studies to prove the point Carson is trying to get across, but also educational in the sense that it educates the reader about the future. This means that when someone reads the book, it almost causes them to have an epiphany, realizing why this book had such an impact.

However, this source does have it’s limitations because it is all through the eyes of Carson. There can be different points of unintentional bias laced throughout the book, and since it’s all written by the same person, the whole book can have the same overlaying bias and ecocentric viewpoint.

Throughout the book, it also makes multiple references to and about Silent Spring, showing what an impact it did as well, which is really helpful, considering the question we are investigating.
This source does have limitations, and this is because it is a scrapbook of different academic journals, websites, and other sources, so there’s a lot of digging when finding out if these different sources are actually reliable.

Film “Supersize Me” by Morgan Spurlock

Supersize Me (Spurlock, 2004) is a documentary starring Morgan Spurlock, incidentally Spurlock directed this documentary as well. This documentary trails Spurlock as he endeavors to eat only McDonalds food for thirty days. Spurlock eats everything on McDonald's menu at least once. He decided to do this experiment to prove the changes that can occur to our bodies when we eat unhealthily, and that obesity is spreading, and the fast food companies don't or won't do something to fix it. This movie was made almost two decades ago and all we need to do is look at the obesity crisis we are dealing with today; the epidemic is so much worse. Not only were Spurlock's findings true but now have brought forth change to our society where fast food is concerned. We have the nutritious labels more readily available everywhere now in part because of the experiments like Morgan Spurlock has conducted.

Spurlock is a very fit and healthy man as this story begins. He consults with many professionals before beginning his experiment. At the beginning of the experiment, Spurlock weighed in at 185 lbs. and had a height of 6'2. There were a few rules that Spurlock had to follow whilst he performed this experiment; He could get exercise by walking approximately 5000 steps per day. (He couldn't observe this as well as he thought he might). Everything he had to eat had to be from McDonalds. He could not consume anything else from any other source. He could 'super-size" what he was ordering, but only when the person at McDonalds offered it to him first.

Fascinatingly, Spurlock's doctors and professionals did not think that eating at McDonalds for 30 days rigorously would affect his body to the degree that it did. At the end of the experiment, Spurlock had gained about 20 pounds and had many other side effects. He had a loss of energy, he was tired all the time, he felt depressed. He became addicted to the food. This addiction to the fast food caused heart palpitations toward the end of the experiment. Spurlock's doctor plead with him to stop the diet and to get back on to a healthier and more nutritious diet. Though it was hard for him to do, he kept going on. At the end of the experiment, the professionals realized that Spurlock had deteriorated much worse than they had predicted that he would.

I chose to do my research project on this because I feel that our world truly has far to go to help its citizens become healthier. If we look at the days of yore, we realize that farmers and hard-working individuals who lived in America didn't have to deal with these sorts of issues. They ate a good, hearty meal but they also worked a good, hearty day. Individuals slaved over a farm or garden or whatever work they needed to do to provide for their families. My point being that they didn't sit around being sedentary. They were moving and moving and moving, working their fingers to the literal bones sometimes.

My question is what has shifted in our ideologies from then until now? The shift has been happening more and more since the 1970s as technology has increased. Because of this processed food became more of an everyday, thing within our lives. Since then the problem with processed foods has become perpetually worse. The problem is technology. Technology is a good thing and a bad thing at the same time. It is good because we have so many things in our world that allow us to keep ourselves living longer lives, the problem is that we also have technology that gives our food additives that allow it to stay 'usable" for longer times. (Mercola, 2015). Yes, we can make our beef stay utilizable but should we, is the real question, and at what cost? We can see that one cost is our health and whether or not we are overweight.

Spurlock did not have any background in nutrition that I could find. However, he didn't go about this experiment blindly. As I have stated in this research paper, he talked to many professionals who helped him make this experiment what it was. He spoke to a cardiologist and a gastroenterologist, and a GP (general practitioner), he also spoke to his personal trainer and also to a nutritionist. Spurlock really did his research on this subject.

The themes of this documentary are very applicable to today. Though Supersize Me (Spurlock,2004) was made in the early 2000s, the results are still thought of today. America is in a crisis regarding obesity at this time. Food is so easily accessible, and it shows. We can drive less than a mile here in Salt Lake City and are able to at least find one fast food restaurant to appease our hunger 'needs". It is truly sad that we as Americans can't see the problems that come from this. We don't see that while additives and preservatives have a purpose, they are so wildly used, and it affects our health.

Spurlock used approximately 5000 kcals per day whilst using the 'McDiet". Our book has told us that men should eat 2200-3000 calories per day, women should eat 1800-2400 calories per day. If a man would like to lose 1 pound per week, he should lower his intake to 1500 calories per day. (Wardlaw, 2015) Spurlock ingested coming close to double what a man should be ingesting per day. That will obviously cause bad effects on a person's health.

Though Spurlock could walk somewhat on the 'McDiet", his output wasn't nearly what is needed and what we have learned about in the book, Wardlaw's Contemporary Nutrition. I don't think that he would have had some of the problems Spurlock had if he would have put more exercise into his daily routine during the time that he was eating so much fast food. Had he done aerobics or played basketball or anything, the number of calories he would have burned may have been enough to help him not gain as much weight as he did during those 30 days. (Wardlaw, 2015)

It is much harder to lose the weight as it is to put the weight on. It took Spurlock many months to lose the close to 20 pounds he gained while on the 'McDiet". If we keep a healthy diet and increase our exercising, we can keep the weight off, It does take some time if we are not where we want to be, but if we continue eating and being more active, we will be able to reach our goals. (Wardlaw, 2015).
After finishing this assignment, I have realized that my food intake must be more purposeful. I am in my forties now and my ability to keep the weight off has been greatly diminished due to my age. I have less of a metabolism which means that I have to really think about what I am putting into my body. I am truly disgusted by what I have been eating at fast food restaurants. It doesn't have to be McDonalds; all fast food restaurants have similar problems. I will be incorporating these ideas in to my life. I know that I want to be around for a long time and the only way for me to make that possible is for me to eat more nutritiously and exercise more.

Exercising is my bane. I really need to learn that aerobics are my friend and so is keeping myself from being sedentary. I want to be as the people of yore who worked for their food and were able to eat more nutritiously.

I need to de-stress my life in order to be more able to not eat the fast foods of the world. Yes, it is easy, but is it worth it? I say 'no" especially after researching this subject.

Documentary Film ” Super Size Me”

Super Size Me" is a 2004 documentary film, directed by Morgan Spurlock. It was filmed to bring awareness to many wrong ways McDonald's fast food and many other fast good corporations can greatly affect your health. The movie is basically the documented phases of Spurlock's experiment, which is eating fast food every day for a month. His experiment consisted of him only eating McDonald's for a month; for breakfast, lunch and dinner. He wanted to see the affects that McDonald's had on you physically and mentally. As the movie went on and time passed there was a definite change in Spurlock. He was sad, experienced major headaches, and chest pain. That was not the only change, though he also began to gain weight, which was the main argument of the film. That Mcdonald's was a leading corporation for the cause of obesity in the United States.

Spurlock was trying to prove to the world that McDonald's was unhealthy and causing people to have high cholesterol etc. Throughout the movie Spurlock meets with many doctors, who tell him that he needs to stop eating the food, because he could cause potential long term damage. This adds to his argument, asserting that the world does not know that, McDonald's could harm you and potentially cause long term life affecting things. By adding the doctors to the film Spurlock showed that he wasn't just stating arguments without facts. Having the doctors added an assertiveness to his argument, basically asserting that he was right and McDonald's is actually bad for you. Spurlock was very smart when it came to directing the film, because the film had a funny feel to it, but it was still very informative. By him doing this he was able to capture his audience, but also spread awareness on the information he was spreading in the film. Spurlock also brings to awareness that McDonald's is trying to appeal to children. This is shown by them offering the kids, kids meals or toys with their meal, but his argument was for the parents. He brought about the question of what parent would feed their kid food that could potentially kill them. This is important, because it starts with the adults, but if he can appeal to the kids as well that is a plus. One instance in the movie he interviewed kids and showed them pictures of Jesus and President Washington and many of the kids didn't know who they were. When he showed them McDonald's characters, they all knew who he was. This brings up awareness that kids know more about fast food than they do about United States history or about Jesus Christ.

I personally think the movie was influential. It definitely got my attention on some of the food that i do eat, however McDonald's is not one of the fast food places that I rush over to go to. I think the movie was produced well. It was not a boring movie. I say that, because most of the documentaries I've seen are very information based and it becomes too much to take in at one time. I think because Spurlock interviewed different people and kept the movie funny, it kept me engaged the whole time. Especially when he was sarcastic goin up to a McDonald's to order his food. I also believe that, because he was on a journey basically and going through the experiment I wanted to watch the movie til the end to see what happened. I do however believe that, because he puts down fast food restaurants he limits himself to the exposure he would get from the full population. I think the movie serves its purpose to bring about awareness on Mcdonald's and to prove that it really can kill you, if you eat it everyday.

I already had a little knowledge on McDonald's and their 'fake" meat or the pink slime put into their meat. This movie personally helped reiterate that knowledge and just remind me to eat right, because it helps your body and your soul. Eating healthy can help with depression and so much more than just the typical things.

Slavery in America and Africa

Slaves in most parts of the African continent were treated like any other person in society. They had the same privileges as any other civilian, but they had several things that they were not permitted to do that other were allowed to. For instance, they were allowed to go to the streams, fetch water, cut wood, and participate in social activities. In the American continent, the slaves were not allowed to contribute to socioeconomic activities unless they were forced to do it by their masters. The slaves in America were forced to do manual labor in the plantations, which is something that was not done to those who resided in Africa. Thus, the Americans and Europeans practice the chattel slavery where the person was perceived as an object with no rights. Slaves in Africa only lost the protection of their families, and one could be put under this condition as a punishment or a process to pay loans.

Length of Service among Slaves in 1618-1700s

The length of services was increased in the sixteenth century as a measure to ensure that they met their developmental milestones for infrastructure. This was brought about by the rise of the indentured servitude in the early years of the sixteenth century. This was the moment that most colonies in North America had not acquired the infrastructure that they would need to have by the seventeenth century, and they need labor to build it. The only way to achieve this objective was to acquire cheap labor by shipping people from other continents who could not complain about the terms of employment or the job. The slaves were needed to serve for a period of four to seven years while they were being paid and offered items of clothing as well as any other basic needs once they arrived in the colonies (Wengrow & Graeber, 2018). The past account of African American slaves started in 1619 with the transition of status from the indentured servants to an eternal slave being a gradual process. Thus, the length of services for the slaves increased over the years with the rise in the demand for cheap labor in the community.

Slavery and Miscegenation


The laws against race mixing were implemented in some states in the USA from 1691 till late 1967 in most of the world. All these bills were designed to ensure that there was no marriage between people of different ethnically defined segments in the USA. Sexual interactions between the white people and the slaves were banned. In America, various state laws prohibited marriages between white people and slaves or native American societies (Payne, 2017). The status of the child born to the slaves would be determined by considering whether the state laws supported the relationship. The reason is the anti-miscegenation laws were enacted uniformly throughout the nation. Violation of these bills was condemned as disgrace, and the interested groups could be killed or incarcerated.

Slaves as Property

In the south, most of the slaves were forced to live and work on the plantations. The people were needed to offer free labor harvesting and planting. The slaves had to work as within their master's homesteads who had the power to beat them or strip them at any point (Johnson, 2017). The diet for the slave working on the plantations was insufficient or inadequate to meet the needs of the people offering services for extended durations. The people were treated as property by being forced to live in the crude quarter that made them to highly vulnerable to the poor weather as well as diseases in the society. The clothing was not sufficient to meet all the slave's needs. The weather conditions in the south were very humid and hot which predisposed them to a significant amount of health conditions (Payne, 2017). Unsanitary conditions, hard labor, and poor nutrition made the people prone to a health condition that resulted in high child mortality rates as compared to that of the white people. All the above circumstances indicate that the slaves were no better than an object that was designed to help fulfill a specific purpose in the community.

Jefferson’s view on Slavery

Thomas Jefferson believed that all the people were created equally and it was wrong for some of the people to be enslaved and suffer at the expense of others. Even though they had already used several slaves in the past and thought they were inferior to white men, Jefferson realized that there was a need to free the slaves (Johnson, 2017). He believed that the institution of slavery was moral evil and a hideous blot that would adversely affect American society if not demolished. Jefferson also claimed that slavery went against all the laws of nature that demanded that all humans had the right to personal freedom. The attitudes held by Jefferson were radical in the society where democracy had been used to the point where it was now more of a norm than anything else.

Slavery and Freedom in America: Edmund S. Morgan

The question over how the republic was dedicated to liberty for all while also being involved witha system of labor that denied human liberty on such a massive scale. He focused his study on Virginia, the largest state by population, size, power and influence, and slave numbers.Morgan began with a look at Elizabethan Britain that revealed the irony of what would come to pass in Virginia: natives and blacks allied with the British to puncture Spanish control inthe New World.

Morgan creates a persuasive argument that early colonists looked upon NativeAmericans and the Cimarron without racial prejudices, which brought him into direct conflict with other the consensus school that asserted racism was a core value in early American culture.In fact this monograph was in itself part of the move from the traditional school of American historians to the revisionist in the 1960s and 1970s.After the vast, yet informational, survey of early colonial America, Morgan turned to address his larger thesis over how the American paradox came into being and what its greater ramifications were. He asserted the problem with the British Empire in the late sixteenth, early seventeenth centuries, was ultimately overpopulation. A remedy to this situation was beneficial double for Virginia and other colonies, as well as the British Isles because it allowed for the expansion of the plantation system while moving less productive citizens from the motherland.

The Virginia experience began as a failed experiment of simply relocating landless, jobless individuals. Morgan then explored how the minority elite class in Virginia quickly transformed the predicaments into a labor system of exploitation. In essence, by the 1670s servitude in Virginia approached closer to slavery than any other institution or practice did at the time. The well known revolt, Bacon’s Rebellion, then marked the watershed of the labor system from indentured servitude, to slavery. Morgan explains that up to Bacon’s Rebellion, African slaveswere rarer because there was already a sufficient supply of indentured servants who would work for a set amount of time to earn their passage. Of course, high mortality rates slackened over time and these servants began to outlive their contracts and Virginia again found itself in asimilar situation of discontent reminiscent of the motherland’s problem when the institution began.

The move to African slavery, Morgan contended, marked a point of unification for thewhite classes; newly freed white servants found ways to reciprocate their experiences by obtaining land and buying slaves who would work for their entire life. To Morgan, this signified a new age, or ideology, of freedom and equality uniform at rudimentary levels across Virginia. It was this crucial link between rising racial animosity and demands for freedom of the white population that was the greatest tragedy and oversight in the founding of the United States
