Capital Punishment for Society Protection

Introduction 

Over the course of humanity, one’s actions make an impact on himself and society that leaves the doer either rewarded or punished. Where the person intentionally harms another that ends their life, society has viewed justice according to the Code of Hammurabi as “eye for an eye, tooth for a tooth” to punish the criminal on height with the offense committed. Capital punishment has been the ultimate method to reassert the wrongness of the crime, its offense to society, and justice for the victims involved. Amid where developed nations have discouraged and intrinsically abolished the death penalty for all cases, including rape, murder, and treason under the pretext that the punishment demeans human dignity in the third millennium, it is assured that some situations still justify its use in order to address social and personal dignity and correspondence to misdeeds made. In the twenty-first century, capital punishment is still a justified method of justice and punishment in the modern world in extreme crimes that violate human dignity for it serves to improve society’s integrity and wellbeing through crime deterrence and compassion for victims.

Committing crimes that intentionally end human life has always been a vicious offense to society that creates a sense of insecurity of society and awareness of the feasibility of such crimes. Where humanity strives to maintain their lives and sense of security, capital punishment satisfies the utilitarianism principle as the act tends to gradually lessen the tragic pain of the victim’s families and, society’s pain of vulnerability, while affirming the victim’s human dignity. John Stuart Mill interprets the utilitarianism principle as society and individual pursuing happiness on parity by stating, “As a means of making the nearest approach to this deal, utility should enjoin, first, the laws and social arrangements should place happiness or the interest of every individual… in harmony with the interest of the whole” (Mill, 2013, 92).

While the interests of the victim(s) and society concur, capital punishment tends to show parity with the crime committed as the grotesque violation of human life is as expensive and valuable as the criminal’s life he is about to lose. Brian Calvert evaluates Locke’s interpretation of utilitarian punishment as it being on height with offense by stating, “The penalty will be determined by and be proportionate to the seriousness of the transgression…by the considerations is what will also serve to fulfill the goals of restraint and reparation” (Calvert, 1993, 215). Regardless of modern thinking and era, the death penalty is another way to punish the criminal while recognizing that the victim’s violated dignity and life is honorable to what the criminal failed to notice. To sanction on the criminal is the way to make clear that there is no punishment strong enough to remedy the loss of a human life as a debt to society and therefore is acceptable that the criminal’s life be ended for society’s safety.

Where gruesome crimes prevail in the modern era, any individual offenses to human life sets an example of an overall danger of such occurrence throughout all society. Where the criminal’s intention to harm poses such vast danger, capital punishment serves as a tool for human protection of those who do not share the same heinous mindset as the criminal. Carol Steiker emphasizes of the need to protect the community as a majority to the whole through deterrence by stating, “…punishment is justified as the product of human agency: the duty to punish derives from the will of the wrongdoer in choosing to offend… punishment is justified in order to protect human agency from private threats” (Steiker, 2005, 774).

In relation the utilitarian principle, the need for individual and collective happiness is satisfied by acting in deterring the criminal through the ultimate punishment in order to rule out any repetition of loss, bloodshed, and tragedy on any other person. Where punishment through judicial death is admissible for taking away human life, the value of such penalty must be the price for the acting at expense of people’s safety and wellbeing. Others may ask in doubt, “Is capital punishment expensive than the potential benefits of other methods of punishment?” While the costs are not monetary, Catalina Popa addresses the influences of the outside world shaping minds of potential criminals in contrast by arguing, “Punishment must clearly outweigh whatever benefits might be derived from a life of crime in the minds of potential criminals. Punishment must be severe” (Popa, 2010, 65).

In the goal to protect society’s happiness and distance from pain in the name of utilitarianism, capital punishment must be enforced according to the severity of the crime and potential dangers that would have posed and have been avoided on a larger scale. Where both collective and individual wellbeing must be accounted for, human life is preserved and valued at all times, including when others fail to do so and are punished.

As the need for capital punishment tends to benefit society as a whole, so must it affect on part of victims and the offender correspondingly. Where the victim’s survivors long for justice through punishment on the criminal and reasserting the victim’s dignity and memory, it fulfills utilitarianism in striving for absence of pain. Leo Barrile reviews the survivor’s perspective of justice and punishment in favor of capital punishment by stating, “Most of the survivors see the death penalty as just, deserving, and warranted for the murder. The most common sentiment expressed by survivors is justice… The punishment is seen as fitting the severity of the crime and as validating the suffering and loss of the victim” (Barrile, 2010, 246).

The importance of capital punishment for justice is straightforward when the purpose of the penalty is to show that there are consequences for human actions that violate the value of human life to the fullest and to the same degree. The consequence on the criminal for his act serves in benefiting the survivor’s need for security and restoration to happiness amid tragic losses, while the criminal faces his fate parallel to the brutality of the crime according to utilitarianism. John Stuart Mill addresses the need for people to receive what they deserve based on their actions in the name of utilitarianism by arguing, “…it is universally considered just that each person should obtain which he deserves; and unjust that he should obtain a good, or be made to undergo an evil, which he does not deserve” (Mill, 2013, 95). For both nature and society, capital punishment is an instrument to satisfy the value of justice and deservedness for the good doer and wrongdoer, respectively, in politically doing what is best to restore the state of fairness for all sides in relation to the actions and severity endured. In the name of utilitarianism, even if the punishment is flawed, the means of enforcing the penalty enables to create the greatest benefit on society at the most while intending to achieve tranquility and security for the survivor and dignifying the victim.

While most of the world has abolished the death penalty, the punishment’s intentions are still effecting in protecting society and survivors, responding in consequence to the criminal’s misdeed. The value of human life is regarded through the whole process in focusing on the victim loss on the survivors to promote benefit and recover and teaching others of the evilness of the crime. In general, the purpose of justice for both sides represents that capital punishment must be seen as a contemporary instrument of justice for human life correspondingly in seeing the reason and purpose through the murder by the criminal and the pain inflicted on the victim and survivors.

Capital Punishment in the US

Introduction

Capital punishment is being put to death by lethal injection for commiting a capital crime. They use to have methods such as hanging (Abolished in 1996), firing squad (Abolished in 2010), electrocution (Abolished in 2013), but they did away with those and went with lethal injection since the person receiving it does not have a chance of being tortured while being executed. There are six states that still use the gas chamber as a method if the injection cannot be given, those states are, Arizona, California, Maryland, Mississippi, Missouri and Wyoming. A capital crime can be different things such as treason or espionage, but the most common capital crimes is premeditated first degree murder. Capital punishment is a controversial topic throughout the United States. Some people like the death penalty, some do not. I personally am for capital punishment being used for capital crimes.

Capital punishment is a controversial topic in the United States, it is legal in 31 different states across the United States, for example a few of them are, Alabama, California, Florida, Louisiana, Nebraska, and Texas. The death penalty is illegal in 19 different states across the United States, some of those states are, Alaska, the District of Columbia, Hawaii, Michigan and New Jersey. It is easy to see that the majority of the country are for the death penalty. The death penalty is a good thing to have because anyone that can commit such horrible crimes, like capital punishment, and not have any remorse for what they have done, do not deserve to get off easy by just spending the remainder of their life in jail. Saying that a murderer getting off easy by spending the rest of his life in prison may sound odd to some people, but they took the life of an innocent person and they get to have a life, even if it is in jail, they are granted to still walk the Earth? Any decision that a person makes throughout the course of a day could have a possibility of leading them to death, and death is the most feared thing in the world.

Having even just the potential threat of the death penalty could possibly help bring a decrease in the number of capital crimes that occur. And in my opinion, our society today is so big on trying to prevent murder, then the death penalty is the more suitable punishment to give someone who commited the capital crime. How can you help bring down crime rates, if there is nothing to give a person who plans to murder a reason to maybe not go off and kill someone? This could even be represented as a more modern “An eye for an eye” (A life for a life) way of looking at the topic of capital punishment because the person who commited the crime would be paying a price that matches up to the harm he brought into the life of the victim and the lives for those around the victim. Families of victims would probably feel a lot better even after the tragedy because justice was served to a person that destroyed the order and peace in their lives.

Another reason to be for the death penalty is to free up space in the jails and lessen the costs that it takes to keep prisoners in the jail. Some prisoners spend an average of 15 years or more on death row waiting for execution, some over the age of 50. The cost to keep a prisoner on death row from the beginning of the case to execution is 1.26 million. That is a lot of money and time for a prisoner to be kept in a cell. In the United States, there are over 2.3 million prisoners in cells right now which is causing the facilities to become overcrowded.

Conclusion

If the amount of time on death row was lower for the inmates that commit capital crimes, it would bring the amount of prisoners down and not have the jails overcrowded. What most people do not see is that when prisons and jails are overcrowded, it is hard for the people who are working there to maintain order and control, especially if they are undermanned. Some states such as Louisiana and Delaware have a very hard time keeping officers on the job because of the large amount of time spent at the prison and how little they get paid drive them away. A man named Gefforey Klopp said that at Vaughn Correctional Facility, they would lose 57% of their hires within 3 years which does not help bring any effectiveness to the place due to the high turnover rate. It is already hard enough to control prisoners with a solid team of officers let alone not being able to make any effective progress when employees constantly come and go. Having the death penalty and freeing up space in our jails could help being back control into overcrowded facilities that have a hard time maintaining control of the inmates they have to spend pretty much everyday with.

Introduction

At the moment I am planning on becoming a pilot. The reason I am interested in pursuing this career is because I have been traveling all of my life pretty much going back and forth between parents, I have always found it interesting. I remember being a little girl and they would take me to the front of the plane and show me the cockpit, I always thought it looked so cool with all the buttons and lights. I always loved looking out down at the cities especially at night, i bet it looks much cooler from the front of the plane. Although this career option did not match the personality tests that I took I think that it will be a good choice for me.

Career Information

What they do: Airline and commercial pilots mostly fly and navigate airplanes, and helicopters. They usually have irregular work schedules, often including overnight layovers. The job of an airline pilot includes transporting passengers and cargo. There are disadvantages of being a pilot, they often experience fatigue and jet lag, also during flights the pilots work in small teams being close to each other for a good amount of time. Airline pilots fly an average of 75 hours per month and work an additional 150 hours per month performing other work activities.

Requirements and Qualifications: To become an airline pilot you need a bachelor? degree and the FAA-issued Airline Transport Pilot certificate or in other words the ATP.

Earnings and Outlook:
The median annual wage for airline pilots was $137, 330 in May of 2017. Pilots are required to retire at the age of 65.

Employment:
The industries that employ people in this career field are Scheduled Air Transportation, Federal Executive Branch, Non Scheduled Air Transportation, Support Activities for Air Transportation, and Technical and Trade schools.

College Information

Who they are: University of Central Arkansas is located in Conway, Arkansas. I picked this college because i am pretty familiar with the campus and it is close to home but not to close. The enrollment is 13, 255. The setting is urban.

What they expect: the minimum requirements for admission are minimum high school grade point average of 2.5, minimum 17 Act composite or 930 on SAT, minimum 15 ACT or SAT equivalent in all individual subject sub-scores, and completion of high school graduation or GED requirements. The annual tuition is $7,889. As a freshmen students do have to live on campus.

What do they offer: I might major in physics and astronomy. The skills that i will have to be good at are Mathematics, problem solving and scientific reasoning, technical knowledge, and good study habits. It is recommended to complete math all the way through pre-calculus.

Financial Aid Information: One scholarship that i plan applying for is the Academic Challenge Scholarship. The only requirement is a 19 on the ACT in which i already have a higher score than that. The reward is two thousand dollars the first year, three thousand dollars the second year, four thousand dollars the third year and five thousand dollars the fourth year. Another scholarship i might apply for is the Governor's Distinguished Scholarship, it depends on if i can make a high enough score on the ACT. The requirements are at least a 32 on the ACT and a 3.5 GPA. The award amount would be ten thousand dollars per year. I will probably have to take out student loans also which are going to suck to pay back. But unfortunately my parents will not provide any help with college because we are broke.

Counter-Argument: There are a few concerns that i have with becoming a pilot. I will not be home a lot of the time so if i want to have a family that is going to suck because i will be gone all of the time. Also pilots have to sit for a long amount of time in a confined area which i am not very fond of. Another career that I have been debating on has been being a math teacher but that would not be a good choice because they get paid very little plus I believe that teachers will be replaced with computers very soon. College might not be the best choice for me because of the money situation but i will be able to figure it out. A college that might be better to attend is one that focuses more on aviation.

Conclusion:

As you can see being a pilot seems pretty great and is a great fit for me even though it did not match the personality test. I have learned that school is going to take a long time and a lot of money but I believe that I can make it through. This is a good career choice for me considering that i know the drill since I have flown all over the country. I also think I will enjoy it because pilots don't usually have to deal with many people which is great in my opinion.

Database from the Engineers Board of Kenya shows that there are 1,848 registered professional engineers, 393 registered consulting engineers and 12,130 graduate engineers. This highlights the critical need for capacity building and knowledge transfer to the younger generation of professionals in the engineering practice with requisite skills to develop well trained personnel to successfully manage the sector. I aim to be a registered professional engineer within the next three years, thus, facilitate and provide experiential training to graduate engineers on road design, construction, rehabilitation, maintenance, and contract administration aspects of projects through mentorship and supervisory roles.

The skills will also be applicable in increasing mobility and enhancing connectivity between resources, processing points and terminal markets especially in Kenya’s Expansion of Roads Programme aimed to construct and rehabilitate national and county roads network. This will go a long way in achieving sustainable national development through adequately trained professionals.
There is demand to research and develop cost effective road construction and maintenance alternatives to the traditional methods and materials.

Kenya is one of the countries identified by DFID funded African Community Access Programme (AfCAP) to deliver safe and sustainable access to rural communities through developing new design standards for low volume sealed roads. The skills acquired from my proposed study would equip me with the ability to promote uptake and update of research findings amongst road practitioners, collaborate and partner in transport research within the region and innovate home grown solutions for our local pavements. This will lay the foundation for deliberate efforts and cost effective operations in developing improved designs and standards for road construction and maintenance to support the country’s socio economic development. According to Economic Survey 2018, road projects across the country have breached ideal cost ceilings.

I aspire to serve an advisory role to the national government on key urban transport issues and in developing policy recommendations. This will involve undertaking research and formulating policy alternatives. My first objective would be developing an urban form framework that encourages the use of public transport and non-motorised modes of travel which will have the effect of reducing reliance on personal motor vehicles. This will reduce congestion and vehicle emissions as we integrate sustainable development goal (SDG).

My second objective would be creating a shift towards transit oriented development that integrates land use and transport planning through development around public transport stations and terminals. This will involve working with senior officials from concerned agencies and departments to create a unified transport and land use plan for metropolitan areas. The UK will be funding the development of Lamu Port city master plan bringing in urban planners, environmental experts and infrastructure planners. I hope to be among the team working on the cities that will benefit from the Ksh 8 billion modernisation fund.

Conclusion

Ultimately, I desire to be in charge of implementing road policies in relation to national roads and planning the development and maintenance of national roads. This would be highly relevant to Kenya as we are undergoing massive infrastructural development for achievement of Kenya’s development blueprint Vision 2030.

Summary of Makeitha Shamburger’s Concern & Relevant History

For the purpose of fulfilling the requirements for this assignment, I had the opportunity to interview Makeitha Shamburger. Growing up in rural Wilcox County, her parents had a very prosperous business of home renovations. Makeitha had a passion and love for interior designing every since she was a high school student. She enjoyed visiting home improvement stores, interior design stores, and researching hospitality and residential designing. She took home economics in high school to strengthen her knowledge /skills. She also took a course in graphic design so she could learn about creating logos for her future boutique. So, it wasn’t shocking that she decided to pursue interior design as a major in college. She attended the University of Alabama and received a Bachelor of Science degree in Interior Design. The program of study included a New York tour, which allowed her to attend furniture fair and meet with professionals in the industry.
After completing the program, she thought it would be easy to obtain a job in Birmingham, Alabama.

To no avail, she was unable to seek employment within the field. Many employers told her they needed individuals with job experience. But being a recent graduate, she lacked the skill. After several months of searching for interior designing job in Alabama, she decided to move to Atlanta, Georgia to seek employment. She encountered the same problem, of not having enough experience. So, she decided to take some classes at the Arts Institute of Atlanta as a resume builder while she searches for employment. On an interview one day, an interviewer told her the story of wanting someone with experience. He asked her if she did an internship, which she did not. He later advised her to consider volunteering at a firm or at their business. She had never thought of the idea of volunteering as a means of getting experience. So, that is what she did. It was a great resume booster, which allowed her to gain experience and references. While doing volunteer work, she learned a lot about textiles and kitchen design.

While doing volunteer work, she had to move home due to a family situation. With the decline of unemployment and relocating to the highest economic challenging county in the state, the family business declined. With the lack of income and a dying passion, she questioned herself as if it really was a passion. After self -reflection and thinking, she realized she only pursued this profession due to family pressures and growing up in the industry. As an adult without any career path or idea of what she would do next, she considered joining the military.

However, she later decided that was not the best idea for her. She started working at a local grocery store in order to earn some money to pay her bills. Although she did not want to work in interior designing, she didn’t like working in a grocery store. She wanted to go back to college but she couldn’t afford to go and most importantly, she didn’t know what she wanted to major in. As the years went by, she received a few promotions on her job, started making more money but she still didn’t have enough money to make ends meet. She was content, but she didn’t want to be employed there. So, she found out a local paper mill was hiring.

She applied for a position there, and she received a job as a laborer. She was excited about the job because her income was triple what she made at the grocery store. As the time went on, she became tired of the long hours, inconsistent off days, shift changes, and working all holidays. Her job became more stressful and strenuous on her body. With the pollutants in the air at the worksite, she started to have health problems, such shortness of breath. She had to take several medical leaves due to her health. Some job vacancies came available in the human resources department and in the business office at the company. She read the qualifications and knew she could perform the tasks. After discussing the matter with her supervisor, she decided to apply for the positions. She received an interview, and did all performance skills, such as filing, budgeting, writing a letter, and calculating salaries/pay, during the interview.

Makeitha had a positive attitude about the interview; she felt that she would receive the position. Upon selecting people for the job, she was not offered a position. She was told she had the skills needed for the job, but she didn’t have the education and job experience needed to acquire the position. The applicants that were offered the job had both. Six months later, her job experienced a major cutback, and she was laid off.

She looked for employment but could not find a job. She lived in a county that had the highest unemployment in the state. After that, she went into a state of depression. According to Paul and Moser (2009), “being unemployed has been shown to be linked to reduced psychosocial wellbeing and life satisfaction, and increase the risk of affective disorders”. She felt sad for most of the day and her daily pleasurable activities diminished. She began to lose weight. She felt worthless. Sadly, she had suicidal thoughts due to unemployment and the stress of her family because of failed expectations. Her parents saw the signs and suicidal characteristics, so they took her to meet with a psychologist. She had to undergo individual counseling sessions once a week. Later, counseling sessions included the family to address some family dynamics.

After a year of counseling, Makeitha felt better than ever. Her mental state was better and she was ready to start a new career or job outlook. However, she was unsure about what career area to pursue. She wanted a profession that coincided with her personality and she also wanted to be a public servant. One of her friends encouraged her to consider going back to college. So, she researched a local college, applied for a scholarship, and was awarded financial assistance that enabled her to consider the option of attending college. She was extremely excited about starting a new phase of her life. Although she was slightly afraid of failure, she had the support of her family and friends.

Assessment - Myers-Briggs Type Indicator (MBTI) Inventory

From her previous background and experiences, I selected that she take the Myers- Briggs Type Indicator (MBTI). The Myers-Briggs Type Indicator is a personality inventory used “to make the theory of psychological types described by C. G. Jung understandable and useful in people's lives”. I thought this inventory would be beneficial for her going forward in her college major decisions to determine the best career, based on her personality traits.

Based on her results on the Meyers- Briggs Type Indicator, Makeitha identified as Extraverted Sensing Feeling Judging, (ESFJ) type. This type of personality included strong practical skills, strong sense of duty, very loyal, sensitive/warm, and good at comforting others. They are well organized and often work best in environments that have clear task and duties. ESFJs are team players. They enjoy working on a team instead of working alone. They are the backbone of the team, assuring the task will be done in a timely manner. They do not have an issue in doing what is needed to be done.

Career paths included accountant, teacher, social workers, and medical care. They require interactions with people and emotional feedback to be satisfied in the workplace. They are good listeners and enthusiastic team members. Weaknesses are their beliefs, thoughts, or habits. They love to be appreciated for their efforts. If their efforts go unnoticed, they may start fishing for ways to get the attention to seek reassurance. ESFJs love people. This is reflective of Makeitha’s high school and college years. She was active in numerous clubs and organizations and enjoyed attending social activities. She was the friend that was always available to comfort a friend in need when things didn’t go as planned. She enjoyed working with the youth at church and in the community, prior to her state of depression. Her enjoyment for life and others has improved drastically with the help of her counselor.

Case Conceptualization- Social Learning & Cognitive Theories

Learning is a remarkably complex process that is influenced by a wide variety of factors. I have chosen the social learning and cognitive theories for Makeitha’s deficits. Makeitha believes that she has learned from her past and believes that everyone has a different view of the world. The world is extremely complex. No one knows what the future will hold. No one knows how interest will change, how new occupations will arise, or how new opportunities will be created. The social learning theory implies that people should not expect to know what they will be doing in the future. It advocates that people can create opportunities by their own action. Makeitha career path has not been successful. She has a Bachelor of Science degree in Interior Design in which she has never held employment. She has always worked in under paid position that was not in her career path.

According to Zunker, “career choice also involves the interaction of cognitive and affective processes. Individuals must be able to process information effectively and think rationally” (Zunker, 2012, p.33). Makeitha’s career choice was based off the environment that she grew up in. She has taken personal responsibility for her career choices and is determine what her path should be through her past experience. According to Zunker, “In sum, social learning theory suggests that learning takes place through observation as well as through direct experience (Zunker, 2012, p.35). An individual beliefs and generalization can be determined by social learning. An individual, who has experienced problems throughout their career, must keep a positive mind and a passionate drive to keep striving for a better life.

Once an individual has experienced setback after setback, their drive and motivations affects their level of performance. Though no one can go back and make a brand new start, anyone can start from now and make a brand new end.
Unplanned events and chance encounters often determine the path that an individual will take in their personal and professional life. According to Zunker, “the primary premise suggests that chance events over one’s life span can have both positive and negative consequences” (Zunker, 2012, p.36). Happenstance is a random occurrence; it is an outcome of an earlier decisions and behaviors, and it is a valuable tool that prompts an individual to take actions or make decisions that may have life altering effects. As we can recognize that Makeitha’s circumstances and events in her life were out of her control. Her genetic and environmental factor had an influence over her life, which are circumstances in which she had little or any control of.

Although many events are out of an individual’s control, they can recognize, create, and use these unplanned events to their advantage. I suggested to Makeitha to keep an open mind and to recognize the opportunities that may come available to her in the direction of her career path and to capitalize on all kinds of events and resources to maximize her learning. Her unplanned events can be seen as career opportunities to excel in life. To help her excel in life, clear attention should be paid to her desires for a satisfying life. It is important to listen to her past and present experiences to encourage her to recognize the potential opportunities in different events. I think that once an individual understand how their experiences in life affect their decisions, they will see how each decision open up the potential for new events. The learning theory of career counseling allows Makeitha to be her own problem solver in her career path.

Career Counseling Goals/Objectives

Now that her life appears to be back on track, Makeitha’s ultimate reason for career counseling is to get an understand of what she wants out of her life, her education, and a true understanding of who she is after a period of unemployment. She has discussed her feelings and concerns as well as her perspective for the future. Based on the Meyers-Briggs Type Indicator, I have gathered feedback to help her move forward in locating the best steps for her future. She is scheduled to attend college in August 2018. Based on her previous experience, she has decided to pursue a degree in Public Administration. She is actively seeking employment at the local department of human resource as a family case manager. She had an interview and she seems confident she will get the job. Although this is not her dream job, she feels she will be successful at it based on her ability to work with the public. “According to Bryant (1995), whenever a change occurs in a person’s life, the individual traits and skills interact with both environmental and situational factors to produce a behavior that leads to the successful adaptation toward change, called resilience.

Resilience is when a person has the capacity to recover quickly from difficulties, in which Makeitha was recovering from unemployment and depression. Her motivation is to re-enter the workforce and further her education. Makeitha’s difficulties have made her want to strive for improvements within her life. She wants to put her best foot forward in the Public Administration program. Makeitha’s goal is to complete the Public Administration program within two years. After completing the program, she would like to obtain employment in one of the following careers: Public Administration Consultant, Education Administration, Administrative Service Manager, or Program Analyst. She hopes that her experience, education and back ground of working with the public would help her to obtain a position in one of the mention career.

Career Standards

Makeitha states that her passion for helping people is what influenced her career development. She states that she is dedicated to her goals because of all the things that she has been through. One of the recommendations I would ask Makeitha is to continue with her journey to employ strategies to achieve further career goals and be successful. Since she has acquired a degree in the past, she is proven that she can obtain success in a postsecondary educational setting. So, she needs to stay focused and develop a balance of self-concept. She is very dependable, have people friendly personality, she will have the ability to work in any work environment. When she enrolls/ start college, she should seek assistance from the student support center when needed. If she feels overwhelmed or starts having difficulty with class or instruction, she should seek assistance immediately.

Since failure appears to be a setback, I think that she should also celebrate successes. Upon the completion of each semester, she should celebrate the successful completion by doing something that is enjoyable as a reward to her. She should not have an overload of classes to prevent her from becoming overwhelmed. As she moves forward with her educational career, her family will be encouraged to offer their full support. If possible, it would be beneficial to continue with family counseling to prevent setbacks. Her family should provide a stress free environment. As she continues to pursue educational endeavors, she should seek opportunities to work/volunteer in the public sector. Volunteering will increase her chances of acquiring a job in the workforce. She should also ask her professors if they know of any opportunities for job shadowing, internships, or its equivale.

I want to go into business because I already took business and management for two years at MPHS. At first, I wasn’t so sure if I wanted to go into business but as I learned more stuff about it I changed my mind. I would love to own my own business I want to be able to own my personal nail, and hair shop I also want to sell food there to. As I was growing up I went from wanting to be a princess to thinking big and extraordinary. My uncle owns his own business and I used to always be around him. So when I got older I wanted to follow my uncle footsteps because I know I can change lives and make my family and myself proud.

Specific Jobs In Chosen Field

Accounting- Systematic and comprehensive recording of financial transactions pertaining to a business Consulting- A professional who provides professional or expert advice in a particular area such as security, management, accountancy, law, human resources, marketing, finance, engineering, science or any of many other specialized.
An entrepreneurship- An individual who, rather than working as an employee, founds and runs a small business, assuming all the risks and rewards of the venture. Entrepreneurs who prove to be successful in taking on the risks of a startup are rewarded with profits, fame and continued growth opportunities.
Finance- Process of providing funds for business activities, making purchases or investing. Financial institutions such as banks are in the business of providing capital to businesses, consumers and investors to help them achieve their goals.
Human Resources - The department is a critical component of employee well-being in any business, no matter how small. HR responsibilities include payroll, benefits, hiring, firing, and keeping up to date with state and federal tax laws.

Certifications or Degrees Needed

I will need at least a bachelor’s degree to enter most of the high-paying occupations. A few exceptions include real estate brokers, insurance sales agents, claims adjusters, examiners, and investigators. In those occupations I may qualify for entry-level jobs with a high school diploma.

In some occupations, it’s helpful for me to have a bachelor’s degree in a specific subject or major in other occupation that are required. Accountants usually need at least a bachelor’s degree in accounting or a related field. Advertising Managers may have an easier time finding a job if their degree is in advertising or journalism.

Work experience is helpful or even required for getting an entry-level business job, depending on the occupation. I can begin building my r©sum© while i’m in school, but when I start my career I have to understand that I may have to work several years to gain the experience I need for the job I want.

Action Plan

I need to go to college to own my own business. I have already taken business and management at MPHS for 2 years. I plan on going to MGCCC to get my degree in business. I plan on enrolling into MGCCC in about a week. I plan on graduation from MPHS. I also plan on going to MGCCC to get my degree in business and I plan on graduating from there in about year or two. After I graduate from MGCCC. I plan going finding somewhere where I can own my own business I plan to have my own personal nail, hair, and food place.

Roadmap to Development of a Career Development Program   

Introduction

When people think of organizational assets, often the first thing that comes to mind are tangible assets; money, machinery, vehicles, computers, raw materials, and finished products. But what about the people behind the scenes that actual make the assets work or even repair the assets when they’re broken? Often times, organizations forget about their most important asset; the human asset. Human assets are no different than tangible assets.  To manage an asset you first have to acquire it, then maintain it, then—in the case of the human asset –develop it and direct it (Fitz-Ez, J. 2005).  Every manager wants an employee who can accomplish any task, but managers can’t just assume the employee will learn it on their own or in “due time.”

An effective way to develop employees for bigger roles and responsibilities is through the use of a career development program. Career development programs are long term investments in employees that motivate, encourage, and inspire professional and personal growth. While career development programs are designed for employees, the organization will see many benefits from a more productive employee (Society for Human Resource Management, 2013). To ensure a career development program is successful it must have six components; Employee learning plan, needs assessment, comprehensive development plan, roadmap to development of a career development program, other factors in the program development, and individual career development plan integrated with the comprehensive development plan.

Employee Learning Plan

Technology is advancing and global competition is increasing therefore it is critical that employees continue to learn as well.  Both the formal and informal learning ability of employees will increase greatly through the use of an employee learning plan. These types of plans assist organizations and employees with planning and managing their professional development. Successful creation of employee learning plans start with a template. Both the human resources team and the management team will need to collaborate in order to create the template. Employee development plans are created just like any kind of plan; creating goals then developing methods to obtain those goals. In an employee development plan, the front line managers create the goals for their employees. After all, it is the managers who know best what they need from their employees. According to Beausaert, Gijeslareas and Segars (2011) there are three steps in developing a learning plan; the first step of the learning plan template will need to identify employee’s learning goals, abilities, knowledge, skills and attitudes that need to be developed. Secondly, a learning method must be chosen that will be needed to develop employee’s’ abilities. Lastly, it is important to establish support for the employee(s) (managers or mentors), in which the employees can turn to for assistance.    

Upon completion of gathering the information for the template, it is time to turn the template into an actual plan. The plan is critical in the success of the employee, and will aid management and mentors in ensuring that employees are following the training laid out for them. The employment development plan needs to have complete buy-in from both the employees and the managers and mentors. Beausaert, Gijeslareas, and Segars (2011) identified four steps that both the employees and managers or mentors must follow to ensure completion of the plan: commit to the plan, follow through with the plan, discuss the progress, and give feedback. One way to show commitment to the plan is for both the employee and managers or mentor to sign the plan. Following through with the plan is as simple as completing the tasks listed in the plan.

Managers must ensure they are following through with the plan by affording employees the time to complete the tasks. When managers and employees come together to discuss the progress of the plan, adjustments can be made to timelines if needed. Lastly, feedback from both parties is a necessity. Employees can provide feedback on the learning material, and managers can recognize employees that are doing a great job along the way.  

Needs Assessment

In order to identify where common problems across departments are occurring, an organization must perform a needs assessment (Brown, 2002).  A thorough needs assessment will utilize multiple resources such as interviews, informal discussions and even surveys. The key to identifying common problems is utilizing a mix of managers and employees. A proper needs assessment will help to create the best career development program. According to Brown, (2002) there are four steps in identifying the information for a needs assessment; Gather information on organizational shortfalls, support from management, evaluating the data, and the cost and benefits of training. Gathering the information is critical in order to ensure the organization is focusing on problematic areas and providing the proper training for employees. Management must remain convinced that the training will benefit their employees. Through data analysis, which will include sales reports, customer surveys, and past employee evaluations, an appropriate training plan can be developed. Lastly, obviously implementing any type of training will impact the company budget. Therefore, evidence will need to be provided to support the benefit of the training.  

Comprehensive Development Plan             

An employee learning plan is used to discover employee’s areas that need improvement, highlights what their strengths are, and provides information on what the employee wants to achieve within the organization.  The employee learning plan can also be utilized as a tool to gather information from employees to identify company development needs (Society for Human Resource Management, 2013).  Employee themselves can act as a source of valuable information.  An organization’s needs should correlate with individual career goals in a sense where personal employee satisfaction and effectiveness go hand in hand with the success of the organization’s objectives (Society for Human Resource Management, 2013).            

Traditionally the learning plan’s information is used for employee personal and professional growth but it also can be used as data for the needs assessment for the organization.  Organizations can use this information to analyze and conclude what the best strategy will be to develop a career development plan for employees and at the same time benefit with that same information for their needs assessment.  Even though the learning plan can be a useful tool to identify assessment needs, HR will need to use multiple sources of information to complete a thorough needs analysis.  For example, employee performance evaluations, and customer satisfaction feedback about employees from each department (Society for Human Resource Management, 2013).              

With creating and implementing a career development plan their can be some gaps that can be associated.  The biggest factor that can cause gaps in the plan is time and budget restraints invested into the plan.  If there not enough money or if there are budget cuts and not enough time set aside to invest in the plan, it can cause the plan to be unsuccessful or show limited success (Society for Human Resource Management, 2013).

Roadmap to Development of a Career Development Program            

A human resource development team committee can provide a great benefit to develop, coordinate, and oversee the comprehensive career plan to make sure personal growth goals and organization objectives are carried out completely.  The committee will be composed of a cross-section of employees throughout the organization that will meet regularly to review the organization’s needs assessment and from the individual learning plan.  Committee members have the opportunity to provide feedback, and advice to HR.  The committee will create an opportunity for a larger level of support among managers and employees from different parts of the organization (Society for Human Resource Management, 2013).              

Other Factors in the Program Development           

Other factors that should be considered in the program’s development is an assessment of   environmental factors within the organization.  Adaptability and adjustments may be required to   meet current needs of the employees and the organization as time progresses.

These factors   include:   

  • New demographic and social trends         
  • Environmental work changes       
  • Position requirement changes     
  • Organization restructuring    
  • Changes in organization policies       
  • Rapid changes in technology (Society for Human Resource Management, 2013).

Individual Career Development Plan

The employee’s integrated plan can be used as a guide for managers to identify gaps in training while at the same time assisting employees in improving their knowledge and skills for a path of more responsibilities or advancement.  Employees will be more motivated and engaged with their employer when management is concerned with their well being along with organization objectives. 

According to the Society for Human Resource Management (2013), “Career development also has a direct impact on the entire organization by improving morale, career satisfaction, motivation, productivity and responsiveness in meeting departmental and organizational objectives” (para. 3). Employees can enhance their knowledge and skills by the integrated plans which will lead to them mastering the duties in their position and will add to their professional development.

The ending results using the integrated plan as a guide will ultimately boost production around the workplace.  Managers must keep in mind when using the plan as a guide they must take in consideration the full life cycle of the employee (Society for Human Resource Management, 2013).

The career that I have in mind was becoming a veterinarian since I was in middle school. Once I started high school I was doing much more research than before. Luckily this career was my interest and type in any way possible. I'm most definitely interested in this career. Although there are many more choices I can choose, I still would like to go to more detail with becoming a vet.

People may not know what are veterinarians but they treat animal health problems. They work to prevent, control, and cure animal diseases. Veterinarians examine animals and ask the animal owners questions. They also give animals shots to prevent them against any type of diseases. Veterinarians talk to the owners that own the animal about the care and feeding of their animal and they keep detailed record about the animals and their treatments.

I've always had an interest in taking care of animal in any type of way. Even when I was small I use to find a way to help animals. Still in this point if I see a hurt animal I will try and make it feel better. The idea of just helping animals out make my lifestyle feel important. The thought of just imagining an animal trying to say thank you because I would save his/her life just make me feel connected and grateful.

I love the idea of being a Veterinarian. I see this career as being helpful and appreciated. I know that if I become a Veterinarian I should know my responsibilities. Veterinarians also perform lab test and exams of sick animals which I need to be careful. They explain test results and review treatment options with animal owners. Although if there is more than one options available, veterinarians help owners decide which option to choose. Veterinarians often prescribe medicines for animals that are ill which they stay in contact with the owners to monitor the condition of the animal and make changes in the treatment.

There are so many types of medications for sick animals such as steroids, pain relievers, doxycycline, and antiparasitic, these medications are the most common uses in America. Steroids are given to pets for inflammation and relief pain. Pain relievers help reduce swelling, stiffness, and joint pain. Doxycycline is used to treat many different bacterial infections including leptospirosis, toxoplasmosis, mycoplasma, psittacosis, and tick-borne disease. Antiparasitic help with hookworm. The prescription for that is oral medication.

For a veterinarian you should definitely have skills and abilities. One skill I should learn is to work with people including, looking for ways to help people, be aware of others’ reactions and understand the possible causes, teach others how to do something, and use several methods to learn or teach new things. Another skill is to use math and science such as using scientific methods to solve problems. One ability is communicating including, speaking clearly so listeners can understand, understand spoken information, understand written information, and read and understand work-related materials.

Another ability is to identify reasons and problems, notice when something is wrong or is likely to go wrong, combine several pieces of information and draw conclusions, use reasoning to discover answers to problems, analyze ideas and use logic to determine their strengths and weakness, recognize the nature of a problem, judge the costs and benefits of a possible action, understand new information or materials by studying and working with them, follow guidelines to arrange objects or actions in a certain order, concentrate and not be distracted while performing a task, develop rules that group items in various ways, think of new ideas about a topic, think of original, unusual, or creative ways to solve problem.

Becoming a veterinarian, I need to have a very strong background in math and science. Helpful electives to take in high school that well prepare anyone for these occupations are animal science, computer application, food and nutrition, anatomy and physiology, safety and first aid. Some other classes I can take are advanced courses in high school includes Advanced Placement (AP) and International Baccalaureate (IB) courses if they are available. A veterinarian should know medicine and dentistry, biology, customer and personal service, English language, mathematics, administration and management, chemistry, and sales and marketing. Medicine and Dentistry is used for injuries and illnesses and plans for treatment. Biology is used for cells, plants, and animals and how they function. Customer and Personal service is used to provide special services to customers based on their needs. English language is used for proper English. Mathematics is used for rules and uses of numbers. Administration and Management is used for how to run a business or group. Chemistry is used for properties of substances and the changes that occur when they interact. Sales and Marketing is used for the methods for selling products and services.

The reason I want to become a veterinarian is because when I was around six or seven I use to live in a farm. In that farm there was a lot of animal such as pig, horses, dogs, cats, sheep's, chickens, rosters, and etc. One day I went outside and found my dog where we would put the horses and he was laying there with his broken hand. I wanted to tell my dad but when I went to check where he was at my mom said he went somewhere, so I went back with some bandages and tape and wrapped it around his hand then took him inside. The next few days I helped him out and every night I wrapped the bandage around his hand. Later on, I was so proud because he was better and that’s one reason I love animals.

Conclusion

I have learned quite a bit about my career of choice in becoming a veterinarian. I'm even more impressed with my research I've done. At the same time, I'm a bit overwhelmed, if I decide to definitely pursue this career, I have many, many years of school ahead of me. I feel like I would provide excellent opportunity and will be helpful on the road to achieving my goals.

Introduction

If I wanted to pursue a career in the Human Resource Department, I would have to have a respectable degree or certification of this field. It is very important for myself to have strong communication skills when taking many calls and speaking with employees. Stepping into this job field I should also be ready to step in and be ready to work in a diverse population. Human Resource is a department of a company which deals with the recruiting, training, screening and administrating the employees of that company. I feel as this career is perfect for myself, because I have a strong passion with working with others and staying organized while handling business.

A Human Resource Manager is supposed to look after the company’s employees, make sure they are motivated to do their best for the company’s sake, define perks and benefits they are to receive in order to make sure they don’t want to leave, manage their general performance, define new ways the entire organization may develop in future, deal with health and safety issues, define training programs that will increase the value of employees.

As a 9th Freshmen I believe that taking this Business and Technology course it will help me familiarize myself to the business terminology and prepare for college and the job world. This job in particular can be seen as proactive because of their continuous development and functions to improve the company workforce. Human resource management is the type of management where almost everybody in managing position can play apart in training and development. Human resource management is the center of an organization and can be seen as the backbone of the company.

This work position connects all departments together to ensure a smooth workflow and communication. This department also works and do their job to ensure the employee is taken care of and that the employee feels that he or she is a valued aspect of the company. Taking care of employees greatly ensures that the employees will in turn provide the best service possible to Managers and such. Throughout this year’s summer, I have gone to work with my mother in HR every week and experience all the business and responsibly she holds for her position. My assignment for the days changed casually from paper filing to payroll on the computer, which I picked up quickly after a few runs. Ever since my mother started her jobs years ago, I grew an interest on computers and everything business related which she thought was adorable and started to educate me here and there.

Whether it is watching her answer the phone or helping her employees, I know for sure I can fulfil this role in the future. Salary ranges can vary widely depend on many important factors, including education, certifications, additional skills, the number of years you have spent in your profession. Typically, HR managers are required to have a bachelor's degree in Business Administration or Human Resource Management. Once you have completed your courses and received your required bachelor’s degree you may now apply for the work force. With the proper training and education becoming a human resource manager can be a rewarding career.

Conclusion

As you first start, you should know that your pay is not going to please your desire, because the more experience and years you put in you may receive a raise. According to the Bureau of Labor Statistics, human resources managers earned an average of $106,910 in 2016 and $51.40 per hour. I did not choose this career because of the money, but for the benefits it provides and the effort it is asking for. In the next 10 years, I plan to work for a corporate company and become its Human Resource Manager who discusses and search for employees to expand the business area while organizing programs while setting up interviews.

My First Career Choice

My first career choice is a physical therapist. I chose this career because all my life I’ve been an active person I’ve played sports since I was four years old and still workout on my free time today. I had an injury my sophomore year of high school and I couldn’t even walk let alone play basketball. This wasn’t the first time I had this injury and I thought that this injury would always reoccur if I played sports. My doctor told me I needed to see a physical therapist. I’ve never been to a physical therapist, so I had no idea what to think. Surprisingly, he healed my injury and I was able to play basketball again. If you didn’t know, a physical therapist is someone who helps people heal their injuries or illness. A physical therapist he rehabilitates their patients and gets them back on their feet. To become a physical therapist, you have to go to school and receive your doctorate degree.

The University of Delaware, University of Pittsburg, and the University of Southern California are the top three colleges in the United States to offer a physical therapy program. The best way to have experience in physical therapy is internships. Internships give you the opportunity to shadow and observe the work environment of a physical therapist. A physical therapist usually works in private offices or clinics. Theirs always being active with the patient.

The median pay in 2017 for physical therapists is $86,850 per year. $41.76 per hour. There are currently 230,000+ physical therapy jobs in the United States. In the next ten years, this number is expected to grow 28% more. UCO offers Kinesiology as a major. Kinesiology is the study of the movement of the body. I’m currently a kinesiology major. This means that I have many career choices still. I chose physical therapist because of how active they are and how much they help other people recover from injuries to get them back o their feet.

My Next Career Choice

My next career choice is a chiropractor. I chose this career because I was always fascinated by their work. It’s the most fun job anyone can do. Chiropractors “treat patients with health problems of the neuromusculoskeletal system, which includes nerves, bones, muscles, ligaments, and tendons. They use spinal adjustments and manipulation, as well as other clinical interventions, to manage patients’ health concerns, such as back and neck pain” (https://www.bls.gov/ooh/healthcare/chiropractors.htm).

Chiropractors believe that helping spinal joints will increase the patient’s overall health. As time goes on, chiropractors are working more and more with other healthcare workers such as physicians and physical therapists. Most chiropractors work in an office and are even self-employed. Chiropractors also need their doctorate degree as well. They get paid about $69,000 per year which is equivalent to $33.00 per hour. In 2016, there as about 47,400 chiropractors in the United States and this number is expected to grow by 12% in the next ten years. As the baby boom generation gets older, the more work chiropractors are going to receive many patients love to go to chiropractors because they use nonsurgical treatments and don’t use medicine.

The best major to take for this career is also kinesiology. Being a physical therapist or chiropractor is one of the most common career choices from kinesiology majors. This fits my interest because it also helps people get back on their feet and I get to listen to the sound a bone cracking. That sounds very weird, but it’s true. I haven’t really chosen which career I wanted to pursue but these are my top two. Both pay very well, and they also help people get back on their feet and be the best that they can be.

Introduction

So what is Sport Management? According to Pitts and Stotlar (2007), the term sport management refers to “the study and practice of all people, activities, businesses, or organizations involved in producing, facilitating, promoting, or organizing any sport-related business or product”. The areas that I would like to focus on is sport law and sport agent.

Sport law is laws that govern athletes and is the guidelines to how they play. Sport law isn't just one law with principles, it refers to several different aspects of the topic. "Sport law refers to "contract, TORT, agency, antitrust, constitution, labor, trademark, sex discrimination, criminal, and tax issues" ("sports law"). "Sport Law can be roughly divided into the areas of amateur, professional, and international sports" ("LII Staff, 2015"). It's hard to decide who is a professional athlete and who is an amateur athlete because amateur students/athletes still receive a form of compensation for their play, whether it be a scholarship, housing arrangements or even job opportunities after college. When even have to deal with that fact that some athletes might be considered an amateur by some but others they are not. In this case, we could say the players who are in the minor leagues are amateurs but technically they can still be considered professional because they are associated with the professional teams but they just aren't paid as much. One of the most popular and important amateur organization is the National Collegiate Athletic Association (NCAA).

The NCAA is in charge of over 1000 member colleges and universities. "Although roughly 50% of the NCAA's members are sponsored by state governments, the Supreme Court has suggested that the eligibility rules of the NCAA are not state action for constitutional law purposes. State action status may also be a factor in mandatory drug testing rules”(“LII Staff, 2015”). Drug testing is one of the many things that division I and II athletes have to sign and agree to do at any more to participate at the college level.

On the other hand, professional sports are different. When it comes to sport law the thing we have to recognize is the relationship between the individual player and the team owner. Their relationship is run by a few basic principles. Each player has a contract that serves as a guideline employment contract between owners and players. Each contract isn't the same it can be modified to each player's wishes and needs and the talents of each player. "With the increase in salaries in professional sports, most players are now represented by agents.

Typically, this relationship is governed by a Standard Representation Contract which defines the duties and compensation of the agent. In an attempt to regulate agent activities, many state legislatures now require agents to register with some type of administrative agency”(“LII Staff, 2015”). Agents can serve as a lawyer type figure to athletes which I will touch upon later. Antitrust problems have always been present when it comes to professional sports leagues. Antitrust is relating to legislation preventing or controlling trusts or other monopolies, with the intention of promoting competition in business(“LII Staff, 2015”).

In the search for a career in sport law I saw a posting for Staff Attorney in Los Angeles, CA. The job is an entry-level position. "Jackson Lewis P.C. is a law firm with more than 800 attorneys in major cities nationwide serving clients across a wide range of practices and industries”(Lewis). This company is a workplace law representative to management that includes the flowing practices; government relations, healthcare, and sports law. This company has a lot of duties and responsibilities that stood out to me. An employee has to be able to handle the defense of discrimination, lawsuits that entail a large range of employment sanctioned claims and guidance involving issues that are similar to the ones listed above. You will be held accountable for being able to successfully represent employers in court, before administrative agencies, at mediations and arbitration. You would be handlining matters in the area of employment, discrimination, contract, employment tort, and non compete cases.

The next job opportunity I would like to talk about is the Sport Agent. Like I stated above a sport agent is like a lawyer type figure for athletes. Sport agents can help sign new players and help players sign to the right team, negotiate salaries, and form relationships. One of the most important jobs a sport agent has is identifying new talent. They can find players in all different types of sports including but not limited to; ice skating, hockey, basketball, football, baseball and a lot of other sports. Professional athletes are required to have an agent to help them acquire the best deals and get them everything they need to be successful. When it comes to signing new players sports agents have to keep watch on all social media and the hottest news to find players who need help and to be managed. "They might fly across the country to meet with athletes living on both coasts and the Midwest, and they might spend hours meeting with those players and their families every day"("What Does a Sports Agent Do?").

Agents need to know how to persuade athletes into signing with them so they have to know how to present themselves in a way that the athletes feel comfortable enough to trust them. Agents have the power to negotiate salaries.

The way this works is the agent figures out what the athlete wants and what the team they are looking at offers and figure out a happy medium. This keeps the player happy and the team owner happy, it's a win-win. Often times the gent will look at what other teams are offering and try to find the best deal for their client. An agent can also help a player negotiate endorsement deals with major companies("What Does a Sports Agent Do?"). Sport agents need to have the ability to form relationships because this is one of the important tasks that an agent has to do. This allows the agent to connect with their client and learn about where they come from and develop an idea of what the athlete wants. "After meeting a player's family, an agent might work harder at helping a player get a contract that will let that athlete remain close by"("What Does a Sports Agent Do?"). Clients will respect their agents more if they see they actually care about them and their family. Agents can also help players figure out what to do after they retire. They can assist them with looking for jobs as analyst and broadcasters("What Does a Sports Agent Do?").

In my search for job opportunities in being a sport agent, I found an advertisement for the Student Sports Agent Program. This is an opportunity to help get my name out there and get my feet wet. The Chris L. Davis Agency is looking to build their sports agency team. They plan to do this by teaching students who have an interest in becoming a sport agent. They plan on teaching them what they need to know about becoming an agent and the skills they will need to be able to close cases successfully. They also will teach them the rules and regulations that sports agents have to follow. This program is based out of Charlotte, North Carolina (Davis, Chris L., 2018.)

A big part of building a great resume is having a good set of strengths and weaknesses. Business love to hear about what your strengths but your weaknesses are also important because that's what denies you as a person. You can't better yourself if you don't know what you need to improve you. My strengths include the following; strong-willed, adventurous, environment adaptive, calm, good listener, educated, independent, open-minded, confident, courageous and optimistic. My weaknesses include; being hesitant, care too much about what people think, passive, and overthinking. In the workplace, your strengths and weakness should include knowledge, skills, and abilities(KSAs). My strengths include: being computer oriented, bachelor's degree in criminal justice(in the progress), people skills, analytical problem solving, patient, determined, disciplined, respectful planning skills, dedicated, honest, reliable, trustworthy, versatile, formal, team player, hard-working, and completing tasks better than expected in other words going above and beyond. My weaknesses include only knowing one language, attempting to please everyone, being too hard on myself and perfectionism.

Most employers look for your career objective on your resume. They want to see how driven you are and what you expect to get out of your employment. My career objective is to obtain a position in sports law or sport agent using the skills and knowledge I gained over the four years of college and 8 years of work experience I already have. I hope to obtain a position that has the opportunity to move up in the company. I don't want to settle for less I want to rise to the top(McGrath 2010).

To develop a successful career plan you need to have a few different strategies. First I will have to figure out what my goals are. My goals would be the find a least five different jobs that I qualify for and apply. When I'm looking for jobs I have to figure out where I want to live and how much I would need to get paid. Also, I would have to look at the benefits that are offered at each job. Next, I have to build a perfect resume. Every job is going to require you to have a resume and its important that its professional and states everything the employer need to know about you. Now I have become aware of my strengths and weaknesses. You don't want to put yourself at a disadvantage applying for a job that you know you won't succeed in. You have to make sure that your strengths are going to out way your weaknesses in the work field.

Next would be to set your stands. Setting your standards at a high level is a great way to start your career because in your mind you can never settle for anything less and if you rise above the standard you set then you'll be golden. Setting your standards high is often the way to be more successful. Next is to figure out how to set yourself apart from others. What makes you better than the next person? This is called branding yourself. This is very important because it makes it easier for companies to make to make their choice on whom to pick. Say you are competing for a job and the other person has the same amount of experience and education as you but you're bilingual. They are always going to pick you. Having several traits is a good thing to have under your belt. Next is making sure that you have a strong networking profile such as LinkedIn, facebook, and twitter. You can find a lot of employers on these social media sites especially LinkedIn. Linkedin is the job version of Facebook. You build your profile and employers can see what you have to offer. Another important thing is to make sure your social media is clean, you don't want an employer to come across of a picture of you intoxicated and making a fool of yourself, that's not professional. After completing all of there are tasks I would submit my applications and wait for them to respond and weigh out which one fits me best(Wislow 2017).

Conclusion

Having a timeline for your career development is also important. You want to make sure you are meeting deadlines and can accomplish all of your goals. But at the same time looking at every opportunity very carefully, you don't want to be trapped at a job for the rest of your life that you make. The worst thing is waking up every day and hating going to work, you want to like your job and enjoy going. It's not all about money it's also about happiness because what's money without happiness? My timeline starts senior year. First, you have to make sure you have an internship or at least have one lined up for the following year. Next is to start the job search. You don't need to submit anything yet but get some options to figure out deadlines. By spring semester you have narrowed down what jobs you wanted and maybe even applied, the sooner the better.

You don't want to get out of school and not know what to do with yourself. Next, once you have figured out what job or internship you wanted you to have to figure out living situations. Once you have that figured out you sit back and wait until graduation. After graduation is when you would start your job. You will be starting at an entry level position so I think it's safe to say that you should set a goal to move up in between 1-2 years. The goal is to move up until you can't move anymore.

The older and more non-childish phase of my life, the more aware I am of the person I have become and how the choices made myself and my family have formed. My family traditions, childhood and standards have influenced my life, cultural views and values allowing me to frame a life, principles, and a family similar in some characteristics to my family, who raised me, while other aspects are amazingly different. With my life and professional goals very different from that of my parents lives and their expectations these influences by class, culture, and ethical teachings are instrumental in shaping my views, perceptions and how they played a part in my current family life.

Back in my childhood, I feel as if I was living life while being contained within a cage. I was born in Roswell which is 30 minutes north of Atlanta, GA. I had three older siblings and three younger siblings who captured the majority of my mother's time and a work alcoholic father, caught up in a capitalistic engineering job playing the hunter/gatherer roll, my dad was never around and never attending any of my games, concerts, etc. As seen in the structural-functional theory as it relates to gender, my mother imitated to societies patriarchy views because during the seventies sexism dictated a woman's place within society. We all attended public school and went without my father to the Baptist church while being forced-fed the same ideals and traditions that where instilled and passed down through my grandparents on both sides of my family. I grew up in what we now consider as a middle-class society and had a very narrow view of the world or the discrimination others endured. My family educational values were dictated through threats for nonconformity in my family to include occasional physical punishment that would be considered deviant behavior in today's world.

Getting older through my teen years and trying to escape the shadows of my three older and three younger siblings, I forged the wrong path academically, while looking for acceptance from people my own age which usually resulted with hanging with the wrong people. I luckily developed good work ethic and habits because my father insisted we all work while school was out during the summer, so we would stay out of trouble and learn about how the economy worked. Upon barley completing high school. I met my now wife right after high school and soon after we met we moved into together and got pregnant with our first child. It was at that point we decided to get married and travel a little bit before we had the baby.

During our new travels, events, meetings, throughout the world really opened my eyes to the gender, spiritual, and cultural discrimination people come across. These views and encounters I experienced further fixed in me that if I wanted more out of life for myself, or for that matter my family later in life, I would have to get into a blue-collar job, so I won't have as many delays, trials, and troubles. I wanted to make sure I achieved success from commitment, blood, sweat, and tears. My wife of thirteen years who chose the gender roles of her own mother and of my mother in working from the home, raising our children. The was the best choice for our family because we felt that someone else raising our children wasn't the best option for them. Even with all the feministic controversy my wife chose the more liberal approach. While raising our three girls and two boys, me coaching or attending all sporting activities, karate tournaments, boy scout trips and meetings. I have not become my father. I was able to play the hunter/gather role in providing for my family, while playing a very important role in shaping our children to be able to handle what challenges and opportunities the world has to offer them.

After twelve years I decided to go back to school to get my bachelor's in business administration. Since being in school, this new journey and opportunity to further my career it has allowed me to expand my educational knowledge. It opened my eyes to the many captivating cultures and diversified ways in which people live, view and cherish their culture and social norms. I have a new respect for individuals and their challenges when dealing with race, and color issues, these life experiences and perceptions have dictated and even altered their general and cultural beliefs creating a world very different from what I have perceived. The saying that with age comes wisdom, is very important along with my family and life experiences in creating the individual I am today.

The EPA said that 75% of the American peoples waste are recyclables, but we only recycle about 30% of it. Some might say that the recycling economy is dying and that it will cost United States citizens more money; however, the recycling industry will keep streets and oceans clean which keeps plastic out of both.

Mandatory recycling programs would be too expensive and cause financial hardship for some municipalities. The recycling industry is slowly going to not exist there for you will need to change your ways of recycling, and pay more for it, as a result (Tita). The material that the people are recycling like paper, plastic, glass, and metal are not turning up high profit anymore they more of a liability, not an asset. According to the Wall Street Journal, Bob Tita wrote, 122 million pounds of recycled glass was used for roads and trash to cover last year because there was no one willing to buy the glass. Recycling markets are changing due to the volatility of changing trends, particularly trends overseas. China has recently changed there recyclers and they are looking for new buyers. The market for different types of paper has gone down drastically in the past year, this means it costs the company to recycle that material (Tita).To run a recycling center you would have to sell what you are recycling if you don't then you run the risk of losing the factory. There are no buyers for mixed glass Wegmans food market ditched glass jars for the pasta sauce and went to plastic. They did this because when shipping glass has a chance to break were as plastic is guaranteed to not break. However, there have been study's made that say in about 20 years the recycling industry will begin to increase and the demand for the recycling industry will become more needed.

Furthermore, The United States recycling management industry is dwindling away that means that they charge residents to recycle their plastics and for disposal of it. Prices for scrap paper and plastic have collapsed, this is charging residents more to collect recyclables. According to Rochester Democrat and Chronicles Steve Orr, The plastics, papers, and cardboard are piling up at recycling plants because they have no one paying for them and they're not being exported or processed in a domestic market. Changes in the economy have cut off exports from the U.S, the world's largest generator of paper scrap and plastics. The people of waste-management authority in Lancaster county doubled the charge that residential trash collectors have to pay to recycle their recyclables (Orr). This will drive the cost up for upgrades for the processing facilities, collecting waste materials, finding different utility vehicles, educating residents by having seminars or different types of programs. Sacramento County collects recyclables. Now, the county is paying what will amount to about $1 million a year, or roughly $35 a ton, to defray the processors' costs (Tita). That increased from $250 thousand as of the next year. This was due to the change in the recycling economy, the price paid to by plastics, glass, and mixed paper. The price that you will pay to recycle may get higher but there are many studies that say in another 100 years we will be drowning in plastics if we do nothing about it. The choice is a world full of plastic laying everywhere or pay a little extra to keep the oceans and the streets clean.

It is often argued that mandatory recycling programs would keep plastics out of the landfills and could be profitable for cities and residents alike. According to the National Geographic Society, Laura Parker wrote, The world has made 9.2 billion tons of recycling and only 6.3 billion made it to a recycling bin. They say for the plastics to biodegrade it would be about 450 years to never. All of the plastics in the ocean are estimated to kill millions of marine wildlife every year. There is a beach in Hawaii that is called big island there are ankle deep microplastics that covers the beach. The sound like rice crispy treats when you step on them. Marine species from zooplankton to large wales are digesting what we produced. This is slowly deteriorating there body from floating in it and eating it. According to the Vermont resource economist Ted Siegler, We know how to pick up garbage. Anyone can do it. We know how to dispose of it. We know how to recycle. It's the matter of building the necessary institutions and systems for it (Parker). If the necessary institutions were built then the oceans would be cleaner and not turn into a thin scoop of plastics. Another word for these small plastics are Microplastics coined by Thompson it means small dissolved plastics which has a large accumulation in the ocean. The recycling institutions would keep not only the oceans clean but the streets of your town or city.

Moreover, the zero waste movement gains traction, so do various waste-to-energy (WTE) technologies. The plans are to turn plastics and even trash into reusable energy or product. This is the basic definition of the term zero waste and waste-to-energy. There are even a growing number of people that have joined the Zero Waste International Alliance (ZWIA). They specialize in establishing a global standard to guide people to the waste-free zero waste standard. This ultimately this is to eliminate the toxicity and waste that is produced by the American people. They have different ways of disposing of the product like incineration, gasification, and pyrolysis these are some of the ways that the eliminate the waste that is produced. Green-friendly micro-factories can reduce landfill, create jobs, provide business opportunities and boost our declining manufacturing sector (Sahajwalla).

The government is the only problem of why this technology is not yet been produced they need the support them, and the businesses need to use it. These micro-factories can operate on like 50 square meters and can be put wherever there is a large stockpile of the recycling. These micro-factories will help make the number of plastics, glass and mix paper is laying around not being reused and recycled back into the cycle. This will help keep the recycling out of the towns and out of the oceans.

As well as, reducing global warming and conserving natural resources. During waste disposal, huge amounts of waste have combusted that lead to the emission of vast greenhouse gases such as carbon dioxide, sulfur, and nitrogen, which contribute to climate change and global warming.(Conserve Energy Future). What happens when you don't recycle it goes to landfills and they get buried and plastics are very toxic to the environment. They are bad for the are. When plastic sits in the sun for hours it produces gases that are toxic when breathed in. Recycling reduces the emission of these fumes and the toxins and handles them properly. Global warming is a problem and fixing one thing at a time will help stop the global warming epidemic.

Starting to recycle all of the recyclable items makes us one step closer to stopping global warming. Recycling is a surefire way of conserving existing raw materials and protecting them for future use. (Conserve Energy Future).As well as getting closer to stopping global warming by recycling this also helps conserve natural resources. If the process of recycling was not around then that means that the new product will need to be made. This means that more trees will be cut down to make paper and more plastics will be made that will just start piling up even more. Stopping are bad habits right now will help us in the long run. Conserving our natural resources should be one of our biggest goals because when we run out we are screwed recycling is the start of saving the resources.

The final analysis is, that even though the recycling industry will cost people more to recycle things properly and the recycling economy is slowly rotting away due to the decrease in recyclable items worth. The people will still benefit from recycling like keeping plastics out of the oceans and street. They also help us get to that zero waste and waste to energy goal while also help stop global warming and slow the depletion of the natural resources. The recycling industry helps remove plastic from the streets and collect the trash and plastics from the oceans.

Magic, Science and Religion are Undefined

Thesis

Magic, science, and religion are not rigid concepts. Their definitions are fluid and flexible in order to bend to encompass each and every worldview that exists. These definitions also change depending on who is defining them, in what context they are defining them in, and what their agenda is. In this paper, we will explore instances of magic, frameworks of science, and the interconnectedness of all things that make religion. Through these examples, we will better see how fluid and flexible these terms are in reality.

Introduction

The dictionary definitions of the terms “magic”, “science”, and “religion” are often oversimplified and boxed-in to follow the rules and constructs of a single and perhaps dominant worldview. However, our world contains many worldviews that do not conform to the rules and constructs of this proposed single dominant worldview. If we stick too strongly to these rigid definitions, we lose a deeper understanding of these other worldviews and thus lose crucial anthropological knowledge. Additionally, by adhering to these inflexible definitions, we unfairly force this one dominant worldview onto others. The definitions of “magic”, “science”, and “religion” must be flexible to allow each worldview to be expressed in its complex, interconnected entirety.

Magic

In her article, “Magic”, Tanya Luhrmann provides an explanation of what the belief in magic does to people who practice it. Having practiced certain magic rituals herself in an effort to better study it, Luhrmann observed that, "It shifts attention from the external to the internal, and blurs the line we draw between the mind and the world. And, as I have argued in my scholarship and teaching, this shift alters the lines we draw. The mind bleeds into the world. Not predictably, and not on demand, and for some more than others, but when it happens, the senses experience what is not materially present." (Luhrmann, 2011) She goes on to define magic as something originating in the imagination, but whose effects can be realized in reality. Her account helps to explain what is real to the individual or group depends on their experiences, beliefs, and worldview. These beliefs should be taken seriously and with respect in an anthropological understanding of a religion, ethnic group, or culture, and as such, the definition of magic no longer has rigid boundaries, but rather each individual has their own definition of magic completely dependent on their interpretations of their life experiences.

In Hallowell’s Ojibwa Ontology, Behavior, and World View, he delves into the topic of magic, more specifically the “realness” of dreams in Ojibwa beliefs and tradition. According to Hallowell, the Ojibwa recount their life events as consisting of both events that occur when awake, as well as those that occur in dreams. Moreover, they often give life events that transpired in their dreams more importance than those that occurred to them when awake: "When we think autobiographically we only include events that happened to us when awake; the Ojibwa include remembered events that have occurred in dreams. And, far from being of subordinate importance, such experiences are for them often of more vital importance than the events of daily waking life." (Hallowell, 1960, p.15) This is an excellent demonstration of how the Ojibwa people experience and view dreams differently from people of popular Western culture who place dream visions in the category of magic or imagination. What is categorized as “magic” in Western culture is simply a part of reality for the Ojibwe, which blurs the boundaries of what “magic” is and isn’t, ultimately calling for a broader, flexible definition of magic altogether. For the Ojibwe, there is no separation between the spiritual and non-spiritual. This identifies the significance of these beliefs to the Native American peoples and how this is not a literal translation, but a spiritual understanding which alters the definition of magic to be broader. In essence, this demonstrates how one must make the strange familiar and the familiar strange in order to truly grasp that the definition of “magic” is not definite or universally applicable.

Another issue with a clearly outlined definition of magic is that it is often assumed to belong solely to “primitive” or “superstitious” peoples -terms which should not be used to describe any group of people- unwittingly linking these concepts to indigenous or tribal people across the globe according to the popular Western culture mindset. This is an incorrect assumption because magic exists and is rather widely practiced in today's Western culture. The concept of magic and superstition are not reserved for people of older eras or of unindustrialized areas but are practiced in new ways every day in our highly educated and highly advanced Western societies. In his book “Baseball Magic”, Gmelch brings attention to American baseball players and the rituals they perform for each game for luck. Now, baseball, like many sports, requires extreme skill but the outcome of the game is a product of not just skill alone, but of chance. This takes a sense of control and predictability out of the players’ hands often leading to anxiety over the uncertainty of the game. As a result, it has become common for baseball players establish their own complex rituals to reduce that anxiety, claiming that these rituals give them luck and improve their skill or concentration (Gmelch, 2000) These rituals and practices of baseball players demonstrate how the concept of magic is often born and the significance it has for the people who practice it. Most importantly, the practice of magic is not reserved for the “primitive” or “superstitious”. Therefore, language such as “primitive”, “superstitious” and “tribal” do not serve to define who practices magic, and the definition of magic blurs more.

Science

It is important to clarify that science is the process of proving facts about the world by backing them with empirical data and repeatable experiments. However, it is also important not to ignore the idea that science intersects with religion and magic more than we acknowledge. The National Academy of Sciences and Institute of Medicine has an online booklet of articles, one of which is “Compatibility of Science and Religion” (National Academy of Sciences and Institute of Medicine, 2018) In this insightful article, they state that “Acceptance of the evidence for evolution can be compatible with religious faith...Scientists and theologians have written eloquently about their awe and wonder at the history of the universe and of life on this planet, explaining that they see no conflict between their faith in God and the evidence for evolution.” (National Academy of Sciences and Institute of Medicine, 2018) This intersection of science and religion can be compatible as well as incompatible, but regardless of the nature of the relationship, they are two spheres that interact with one another and do not stand alone, which feeds into why the definition of science must be fluid.

To add to the needed fluidity and flexibility in the definition of science, scientific paradigms shift and change over time. If what science consists of can alter, then the definition must be able to follow suit. Thomas Nickle in his introduction to Kuhn’s ideas stated that “...Kuhn gave us a very different picture of science. Kuhn contended that there are two types of mature physical science, 'normal science' and 'extraordinary' or 'revolutionary science'. In a given scientific field, long periods of conservative, tradition-bound normal science are punctuated by an occasional crisis and, still less frequently, by a revolution.” (Nickels, p.1) According to Nickle, Kuhn understood that paradigms are impermanent and that adjustments and alterations are made over time to better fit new knowledge. Furthermore, paradigm shifts influence people’s beliefs, and people’s beliefs influence paradigms. This is proof that there exists an overlap between science and religion that an inflexible definition of science does not account for.

Religion

In a TED talk, Wade Davis elaborates upon the interconnectedness of religions and human constructs across the globe (Davis, 2008) Davis states that there is no linear progression of these ideas coming into existence, but rather a web of things that morph and change along with paradigm shifts, belief shifts, culture shifts, etc. Demonstrating the fluidity and flexibility of the definition of religion, Davis says, “…unraveling the complex threads of memory inherent in a myth, is simply a matter of choice and cultural orientation. There is no progression of affairs in human experience. There is no trajectory of progress. There's no pyramid that conveniently places Victorian England at the apex and descends down the flanks to the so-called primitives of the world. All peoples are simply cultural options, different visions of life itself.” (Davis, 2008) There is not linear progression or straight, traceable chronology to how worldviews and beliefs shift. Rather, it is a constantly changing web of interconnectedness. The definition of religion must be broad enough to allow for the constant alteration.

In the same line of thought, Anne Fadiman, author of “The Spirit Catches You and You Fall Down”, eloquently stated after a realization during her study of a Hmong family caught in the crosshairs of Western medicine culture that “Medicine was religion. Religion was society. Society was medicine.” (Fadiman, 1997) This story of a medical journey paints a vivid picture of the Hmong vs. Western Medicine dynamic that shows how flexible the definition of religion must be for people to better understand other worldviews outside of their own, or outside of a dominant worldview. The idea that medicine is religion, religion is society and society is medicine shows just how connected these different spheres are and the definition of religion should be able to encompass that.

A PEW study that surveyed over 4,700 adults in the US found that about 90% of Americans believe in a higher power, but only a small number believe in God as defined in the Bible, as some supreme being, or as a spiritual force. The research also found that beliefs change from one generation to the next, in the younger peoples, and as people get more educated (Pew Research Center's Religion & Public Life Project, 2018) This research empirically demonstrates that religion, beliefs, and worldviews are subject to shifts in paradigms and that we live in an ever-changing religious landscape. These varied and changing beliefs of the people contribute to a need for a flexible definition of religion.

The definitions of “magic”, “science”, and “religion” must be flexible to allow each worldview to be expressed in its complex, interconnected entirety. The true definitions of these concepts overlap and bleed into one another to a point where, like good infrastructure, they must be plastic and accommodate any shifts, changes or interconnection that occur.

Capital Punishment and Redemption

Introduction

In 2005, a man named Stanley Tookie Williams was sentenced to death by the State of California after being convicted of murdering four people. While waiting for his execution, Williams attempted to make amends by writing children’s books that warned about the dangers of gangs and violence. Because of these acts, many people believed that Williams’ sentence should be reduced to life in prison. The governor of California, Arnold Schwarzenegger, did not believe he truly regretted his actions, due to the fact that he laughed and bragged about the situation while on trial, and rejected his plea for clemency. Was the governor’s decision to execute Stanley Williams morally permissible? Should his attempts at redemption allow him to have a lesser sentence? It was morally right of Governor Schwarzenegger to uphold the decision to execute Stanley Williams.

According to Social Contract Theory, the morally right action is the one that adheres to the set of rule a person has agreed to follow. In this situation, the United States Constitution is the social contract that governor Schwarzenegger had to abide by. Although it does not explicitly say what should be done in cases involving capital punishment, the eighth Amendment does ensure that a person cannot be deprived of their life, liberty, or property without a fair trail for the crime they are accused of. Williams was given a fair trial and he was found guilty. As a result, the state of California had the right to execute him. Even though he tried to amend his situation, it does not change the fact that he was convicted of four murders. If Governor Schwarzenegger had granted Williams’ plea for clemency, he would have broken the rules of the social contract. This could potentially cause other criminals on death row to do some sort of charity work with the motivation that they, too, could be given a lesser sentence. There is no room for exceptions in the social contract, so therefore no exception can be made for Stanley Williams.

The Categorical Imperative states that right actions must be carried out regardless of what our particular wants or needs are. This concept plays a vital role in defining Kant’s form of ethics. Kant believed that there was a maxim, or rule, that could be applied to every situation. These rules are universal and indisputable. In regards to justice, Kant’s ethics believes that criminals should be given a punishment that is as severe as the crime they committed. With this knowledge, the conclusion can be drawn that the categorical imperative would not allow Governor Schwarzenegger to lessen Mr. Williams’ sentence. The punishment of life in prison is not equal to the crime of murdering four people. Furthermore, the categorical imperative does not believe that redemption is related to justice. The fact that Williams wrote books for children does not change the crime he committed, and therefore it should not change his sentencing. If Governor Schwarzenegger were to give Stanley Williams a less harsh punishment, he would be universalizing this action. As a result, all murderers who tried to seek redemption would be given life in prison instead of an execution.

According to the text, Ethical Egoism is the moral theory that says that the right action is the one that produces the most favorable balance of good and evil for oneself. This means that in every situation, ethical egoists ask themselves which action will create the best outcome for them. Because ethical egoism is so individualized, it is impossible to state that all ethical egoists would agree with Governor Schwarzenegger’s decision to execute Stanley Williams. If an ethical egoist was living in California while the drama surrounding Mr. Williams unfolded, it can be assumed that this specific person would want him to be executed. They might think about how their safety would be compromised if Williams was allowed to live. There would be a chance, however slim, that Williams could escape from prison and terrorize citizens of California as he had before. They could also think about what impression the situation would leave on society. People could see this as an opportunity to act recklessly because they believe that they may not receive the full punishment. This would cause a serious strain on everyone in society, including the ethical egoist.

Conclusion

Because of Social Contract Theory, the Categorical Imperative, and Ethical Egoism, Governor Schwarzenegger’s decision to execute Stanley Williams was justified. Rules have been created for situations like this one, and if those rules are not followed, the consequences can be severe. The stability of society should not be compromised in order to cater to the wants of a single criminal.

The persistent hum of a fluorescent bulb fails to drown the sound of your heartbeat, your thoughts, the faint weeping of your mother. A warm sensation travels through cold veins, there is no return now. Perhaps a lifetime in supermax would have been worse, but perhaps you should not have slaughtered that girl. Did you? She wanted it. Where are you? The lights become fuzzy and your muscles contract. Helplessly and vigorously you writhe, like a great predator in the captivity of his hunter. Existence becomes pain until you cease to exist, and find liberation from mortal responsibility.

The United States government saw to the deprivation of your life, among twenty other lives in 2018, through capital punishment. This permanent mode of retribution and subsequent safety of the general population demands controversy throughout the history of the American criminal justice system. In some cohorts, the life sentence suffices as just repercussion for dangerous inmates. In others, capital punishment serves as a repulsive deterrent for future offenders. The heated debate over the necessity of execution or lack thereof takes years of statistical studies, special cases, and public opinion into question. Death is not a gentle act, and thus requires due support and justification from those who deliver it. Society asserts that capital punishment is an effective method of deterrence and crime prevention in order to justify their own dark desire for retribution.

From the gallows of Puritan Massachusetts to the execution chamber in Huntsville, Texas, capital punishment holds onto its harrowing place in the American criminal justice system with fervor. The colonists, though more conservative than England, liberally dealt the maximum punishment for violent offenders or repeated offenders of lesser crimes. Murder, rape, witchcraft, and incorrect religious affiliation sent dozens of citizens to death, often with little contention from the masses (Malik 695). Biblical text and other archaic tradition provided enough reasoning to society at the time. People widely accepted the exchange of bloodshed humanity partook in, as it was the way things always were. In the years after the revolution, “America evolved from its predominantly religious beginnings” and citizens began to challenge the nature of criminal execution (Malik 696).

The death penalty now exclusively applied to murders, rapists, and traitors to the nation. Sentiments in opposition to execution gained strength until the abolition of public hanging practices. In the 1880’s a number of states declared hanging as barbaric and thus introduced the electric chair. The electrocution execution of Jesse Tefaro highlights the occurrence of human error in any method of capital punishment. In the case of Tefaro, an improper head sponge was put in place to conduct the electrical charge to the brain, resulting in “six-inch flames [blazing] from his head...and three more rounds of jolts to stop his heart entirely” (Hodgkinson 161).

One the electric chair became too violent for the taste of America, death by asphyxiation became the popular route in the chamber. Donald Harding of Arizona was given cyanide tablets to induce suffocation in the Arizona prison. Witnesses recounted seeing Harding’s “body turn from red to purple...as violent spasms and jerks” lasted nearly seven minutes (Hodgkinson 163). The usage and evolution of this process gradually became focused on the public interest, rather than that of the justice system or the victims it aims to honor. Throughout the twentieth century, new methods of execution leading to the modern chemical injection were developed to make the process “less visually disturbing to onlookers” than the ways of old (Malik 700).

Strong sentiments in opposition to the death and violence of the Vietnam War impacted opinion on capital punishment and drove support to an all- time low. Formative events and influential Supreme Court cases such as Furman v. Georgia which suspended all executions for a brief period, disturbed the benumbed United States enough to reevaluate cruel and arbitrary aspects of the matter (Anderson 845). Modern dialogue suggests that this interest in reform stems from a place of guilt in man upon realizing the egoistic nature of vengeance.

Three main proponents of capital punishment are deterrence, retention and retribution. The relationship between deterrence and retribution examines the issues societal justification of the death penalty presents. Deterrence refers to the action of preventing aspiring offenders from committing heinous crimes by ‘making an example’ of inmates on death row. Retired judge and former federal prosecutor James P. Gray comments that premeditated or paid murders are the only circumstances in which lethal injection has the potential to change the killer’s mind. The vast majority of homicides occur in situations that are unplanned, violent, and too quick to weigh the consequences to come (Gray 257). Homicide committed in kidnapping, gang related, or otherwise premeditated scenarios are typically in the hands of a mentally ill individual, an individual who believes they have nothing to lose, or by an individual who feels their reasoning outweighs any risk of penalty. Hubris in the heart of killers creates a sense of invincibility against the law, and it is a deep rot in the psyche that cannot be exterminated by syringe.

Philosophical aspects of good versus evil action aside, does lethal injection serve as an effective deterrent for murder?

Advocates for criminal execution are quick to claim that deterrence rates affirm the fatal practice is “an uniquely effective deterrent to murder” compared to life sentences (Lamperti 1). This common argument stumps the uninformed interlocutor, who ought to know that the statistics are in their corner. Professor John Lamperti of Dartmouth College asserts that after all, “factual evidence can and should [influence]” legislation concerning American lives. (Lamperti 1). Without the ability to carry out a controlled experiment on murder, researchers must take decades of data from the United States Census Bureau and retroactively determine the relationship between providence of the death penalty and its effect on murder rates. States with and without the death penalty in each geographical region were studied from 1920 to 1958 by then renowned sociologist Thorsten Sellin .

The data revealed that homicide trends were mostly indistinguishable from any state. Another study conducted on homicide trends analyzed data from 1973 to 1984, and astoundly suggested that states with the death penalty experienced higher rates of murder than their non-executing counterparts (Lamperti 3-5). As more data is introduced, researchers continue to conclude that capital punishment shows no association or causal relationship to homicide decrease. Such conclusion cannot account for murders that never took place as a result of deterrence, however it can support the claim that any deterrent effect holds an insignificant impact. Such conclusion also challenges the pro-death penalty side further. If capital punishment does not serve as a statistically effective deterrent of murder, what drives its preservation?

The third proponent of execution by lethal injection, retribution, is the most complex of the set. Retribution is the deliverance of punishment as consequence of wrongdoing against an individual or institution. Capital punishment is the highest degree of retribution in the justice system and is thus exclusively enacted on the most animalistic convicts. A violent crimes meets a violent end. Consider the point-and-blame American public and the historical journey from gruesome spectacles to private injection chambers.

The process was shaped to become more humane to the general population who imposed the legislation (Radelet 43-46). In this way, Americans find it easier to turn their heads from the moral and ethical implications of the death penalty. If the general population comprehends the cruel reality of capital punishment, it is plausible that precarious arguments like deterrent effectiveness merely acts as a proxy for pure relishment found in revenge.

Two perspectives of retribution arise; that which satisfies the victim’s family and that which satisfies a greater human depravity. In early civilization it was only logistical to impose equivalent pain onto the perpetrator to not defame the deceased. The ancient statues of vengeance upheld one’s family honor and preserved justice. In the present day the argument supporting the death penalty stresses the pain experienced by the victim’s family that will go unresolved without proper retribution. Closure is subjective for each grieving individual, especially for the loved ones of a murder victim. The value of the human life cannot be empirically or monetarily be measured. It is not replaceable or comparable to the life of another human being. Despite the most solid pro-death penalty arguments uttered in the marketplace of ideas today, no noose, no firing squad, no chair, no gas, or no chemical can bring the victim back into the world. Most inmates on death row spend years in custody awaiting appeals, trials and retrials, all of which are emotionally and financially exhausting for the family on the other side. After years of depressing undulation, not “much satisfaction [arises] when the object of one’s hatred simply goes to sleep...hooked up to a needle” at their end (Gray 257). Many families would recover better knowing that the offender is locked away, left to rot, never to hurt another soul. When a family does not want to pursue the death penalty the legal system encourages follow through for the sake of the victim’s honor. Some may chop it up to a final display of respect, others just become engulfed by the American standard of violence. Is this cathartic? The family must carry the burden of tragedy, the killer is liberated from human law.

Conclusion

How can we, as a nation, strive to be the “champion of human rights if [we are] so at odds” with an issue that potentially brings us to destruction (Gray 258)? The United States criminal justice system views retribution as a display of power for the government and humanity itself. Whether death comes from a jawbone or a freakish curation of pancuronium bromide and potassium chloride, it disturbs the order of nature and man’s place within it.

Deterrence in the broader sense can be extended to justify actions that suppress civil progress and violate constitutional rights for societal good. Even though capital punishment is solely perpetuated by the benefits of public safety, criticisms claim that wrongful executions contribute to racial and class bias in the country. Studies discussed in “Age, Period, and Cohort Effects on Death Penalty Attitudes in The United States, 1974-2014” show that the proportion of executed inmates is overwhelmingly African American or Hispanic when compared to the number of white criminals who do not see the chamber or otherwise get off death row. A country that has the power to exercise judgement of who lives and dies as if no other form of rehabilitation or ramification is feasible influences constituents to indulge in their selfish desires and hold lesser regard for life. People want their pain to matter.

They know that nothing will take it away, so they must witness the suffering of another to receive a sense of validity. There is no due justification for rape and murder, why would there be proper reasoning for an ultimate hurrah of violence? It is aestheticization of violence in our culture. It is a self serving need to survive and to be feared. Let the offender rot in prison, burn in hell, or slip into nothingness– lest you find the everlasting stain of blood on your hands as well.
